I'm just wondering if anyone knows how to cancel an appeal for an I-130 petition that was denied several years ago. Our appeal was filed over 3 years ago but our senator's office said the information they got was that it's still pending and there's no time limit on giving a decision. It seems like it would be easier and faster to just start all over but I don't want to be denied right away because of a pending appeal on an old petition.

Send a withdrawal letter for the old petition, citing both petitioner and beneficiary full names and dates of birth and the case number, when you file the new petition.

However, if USCIS was right to deny the original petition and nothing has changed, filing a new one will do you no good. What has changed (other than the passing of time) since the first petition was denied? What reason did they give for denying it?
