My fiancee is in danger of losing her job in Hong Kong. How does she get her passport back if she is in Administrative Processing? I am very worried she will be denied and then won't even have a job and be stuck in the Philippines. She is very unhappy there. Also, is it possible to send the passport back via DHL once you use it to travel? We have been so miserable waiting and I'm sure she would be much happier in Hong Kong. I would really appreciate it if someone could answer! We called the embassy and they said to email them. :( We don't have too much time left before she loses her job.

Did you email USEM to get their input regarding getting the beneficiaries passport while still in AP?

I personally have never heard of a case in AP where the passport was requested by the petitioner and/or beneficiary for immediate travel.

i emailed them but it takes 7 days for them to respond and they have a poor track record of actually answering questions. I'm also a bit concerned that getting the passport back could effect the final outcome. The whole situation is just nightmarish.

I agree, it is a nightmare! Wish I could offer you more, I've never heard of anyone needing to get back a passport while in AP.

Would you let us know how USEM resolves your issue?

Is there a specific problem that she is in AP for? Maybe if you just wait it will be out of AP sooner than you think. Usually when there is extended AP they don't even ask for the passport in the first place, much less keep it.

The embassy always asks for the passport and only returns it early if the visa is denied, for those going through extended AP they keep the passport.

I see you are going on about a month since the interview did the embassy issue a 221g at the end of the interview? Did you have the police certificate from HK?

It does seem like it is taking longer then "normal" to process the visa, even for these days. I hope everything goes well... and you get the visa soon so the job in HK is not needed ;)

I wish I could say our situation is simple. My fiancee was asked about my savings and because she never looked at the documents I sent her she answered incorrectly. This, combined with assets that don't line up with my income probably put us in AP. I recently sent them additional evidence demonstrating how I accrued my assets. They never specifically asked for proof but they did say that we were in AP because of "income" and "savings". We just don't know what to do.

No it wasn't but I provided assets above and beyond what was necessary. For instance, I showed deposits of 24,000 dollars but it wasn't on my W2 because it wasn't taxable earnings. I sent them documentation proving this recently. Hopefully this will help. The assets and deposits came from a Trust.

I know of another couple where the embassy would not look at his assets, required him to get a co-sponsor. Because you are receiving yearly income from yours makes it a different story. You didn't provide documentation to substantiate your "other income" for the interview? Well the embassy has it now, hopefully all will go well now. Please keep us posted... we all learn this way.

I didn't get called on my non-taxable income during the visa process but I did later during AOS ... go figure.
