Hi:

I'm new to the forum. I met my husband in the summer of 2001. He entered the U.S. without inspection in March of 2001. Because of the issues of 9/11 and no immigration reform, we pause on getting marry afraid this will cause hardship on applying to his permanent residency. We learned last summer (2013), we could get marry now and apply a 601A, if our application got approved. We married in October 2013 (Happiest day in our lives), and proceeded to filed an I-130. We waited and after a couple of months we got a RFE, which we replied to and in a week's time our case (I-130 application) got Approved (From April 25 to May 2). We considered ourselves lucky.

Now, here is my question, what's next? I got the email saying our approved package was sent to the NVC (status Post Activity Decision),that we will get mail from the NVC within 30 days, and to follow directions. I read in a post here (that I cannot find now), we should call the NVC after ten days and ask for the case #. To make online contact with the NVC.

Can someone point the way to us? Where can I research on what to do next since we have yet to receive correspondence from the NVC. How do I contact them or should I wait until we get the NVC's mail?

The number to the NVC is 603-334-0700.

The line is usually always busy, so keep trying back. Once you do get put on hold, expect a decent wait time before someone picks up.

Have your Receipt Number and the name and birth date of your fiance to give to them.

Feb 22 2016: Called and found out another RFE was being sent out about birth certificate

Feb 24 2016: Sent in (inextensa versions, not de acta versions) of birth certificates for all children

Mar 02 2016: Received notice that they received the RFE evidence

Mar 11 2016: NVC Process finished, now awaiting interview time slot to be scheduled

Mar 29 2016: Called NVC and found out today they scheduled interview

Apr 01 2016: Received Packet 4 notice via e-mail with interview date

Apr 25 2016: Children received P4 letters in the mail

He's going to be denied because he EWI. He will need a waiver for the 601. There is a site that specializes in people who EWI and 601 waivers. You might want to check it out. Immigrate2US.net. There are some great people on that site with mucho experience in waivers. There is also an attorney that holds free chats every

Wednesday where she answers questions for applicants. I would recommend you check it out and best of fortune on your journey.

NVC will send his file to the embassy in his country. He will interview there and be denied because of the EWI. He may then be offered a waiver based on extreme hardship to you the petitioner. The I601 Waiver is very complicated and requires tons of evidence from you to prove hardship. I would advise you to start now working on your hardship letter and gathering evidence, IM2US site also has examples of approved and denied hardship letters. Go to the site because you are definitely going to need their help. There is a lot of experienced people there and there is also an attorney chat where you can ask the attorney questions free of charge.

Thanks to everybody:

I will be checking on that lawyer in the immigrate2 site (I've been there as well, much help there too).

I called the NVC to obtain the case# (not yet assigned).

I've been practicing filling out the AOS (I-864) application. The form is new; My question right now is in regards to the Individual Annual Income. In Part 6, question #5; Since I am unemployed and finished my unemployment benefits, what amount do I put in this line. Do I put 2013 Income from line 22 of the 1040 tax returns or do I put "0". I'm guessing we need a sponsor if the amount is "0".

My husband's sister is U.S. naturalized citizen, self employed, but there's an "IF". Because she's Self-Employed, her income on the 1040/2013 line 22, is 1,942 and Schedule C added up her 1099's and it states 24,564. Do I add up the 1099's as income and put this as her income on the I-864 (we also have her paystubs for 6 months; she is a Child Care Provider)? So that in this way, surpasses the 125% poverty guide level? I am a little confused.

My husband and I called the NVC and ......We have a case#....Yeeeehhhhh!!!!!

I'm so excited....what do I do next? I gave the receipt, husband's name and D.O.B., and our emails...OMG!!!!!

Where do I go from here!!!!!

I've been following the guidelines from the guides provided here, (thanks for the advise). So yes; we got the case# and Invoice#. I know it says not to panic if we get the message about "Your case is not eligible yet for processing" (something like that), because that means they are working on your case and might be loading the IV as well. And so I read also, we have to fill out the DS-261(choice of agent) and DS-260(Me).

My question is, since I've been checking everyday and gave the NVC our emails, do they send you the DS-261 & DS-260 via email, and then the AOS bill and application? What do I do? Wait some more? I am excited, yet anxious, and I want to do this already, Lord help me.

P.S. I didn't quite understand the question about being a USC or LPR? Can you explain this to me? I need to know everything about these procedures. Any insights, Anyone?

USC or LPR ... United States Citizen or a Legal Permanent Resident?

As far as what to do next, all I can say is follow the guides as I am going through the K-1 process and not the same process you are going through.

I'm USC of Puerto Rican Heritage then, my husband is from the Dominican Republic. Everyday I grow more anxious, since I am doing all the paperwork myself. I have always helped other people fill out applications (including my family members). My goal right now is to stay focus... I'm really good at these things, but the wait period can make one so nervous.

I have been checking everyday, and I know the Guidelines say not to panic, but the uncertainty is driving me crazy. We are still waiting for the DS-261 so that we can do the AOS. We're ready, its been 4 business days and nothing (lol, I can be a drama queen). I just want my husband to feel part of this country as I am. Hopefully, tomorrow the forms are available. (after 13 years together, you would've thought we would be tired of each other. This situation has made our relationship stronger, and that's our strength).

Hello Everyone:

So yes, I wanted to mention that we finally filled out the DS-261, which appear this morning when I logged in. We printed out the confirmation page and it says we should wait 3-5 for the AOS Bill to appear. We are progressing. TTG

As I am reading about the "IV", I have a question about the POLICE CERTIFICATE? I did research and found out, here in NYC you can apply directly in person at:

LETTER OF YOUR STATUS OF IMMIGRATION FROM U.S.C.I. (NOA2, JUST IN CASE)

-YOU WILL GET FINGERPRINT

PROCESS TIME: 5-10 BUSINESS DAYS

This is just in case anyone needs the information as well. Now my question is;

I read many post about this. Since I am petitioning my husband, and he has lived in the U.S. since 2002 (he was 27 years old then), do we need to acquire a Police Certificate from his country as well?
