I-129F RFE Question...

Timeline

My wife and I are applying for an I-129F, we both live in Brazil. I just received a RFE for the I-129F. I started the process before finding VisaJourney.com so I sadly, I was expecting this.

I have a couple of questions (yes I searched the forums but I kept only finding posts from 2006)...

1. My wife's I-130 also received an RFE at the same time... If we ignore the RFE for the I-130 and send the info for her I-129F, will there be a problem with getting her K-3?

2. Or in your opinions, should we scrap the I-129 and just push forward with the I-130?

3. How long does it usually take to get approval after the required documents are received?

*We have no problem with getting the K-3 and finishing the process for her Permanent Visa in the States.*

I am no expert but something is wrong here if you are already married you should not be doing a 129F that is for a person to bring over his or her Fiancee. If you are married I would assume you should continue with the 130 and drop the 129 F. Please correct me if I am wrong everyone.

The process for the K-3 Visa is submitting the I-130, then Submitting the I-129F. Same document for both, Its very confusing.

Timeline:

I-130 Sent: 11/11/2013

I-130 NOA1: 11/26/2013

I-130 RFE: 5/8/2014

The K-3 is obsolete. You need to file for the I-130 (and if you still want to file the I-129F that's fine) but it will be administratively closed as soon as your I-130 is adjudicated.

DO NOT ignore the RFE for the I-130. What did it ask for, specifically? that is what you should send to USCIS.

You can stay with your wife during the process. When you reach the NVC stage (after you get the NOA2 approval), then you need to provide proof that you have established domicile in the US. Cross that bridge when you get there. Focus on responding to the RFE for the I-130 (which may be the same as the one for the I-129F).

I also filed for the K-3 along with the I-130 but it was closed as soon as I got the NOA2.

I just looked at your timeline. You filed the I-130 in November 2013. The fact that you got an RFE is good news! You are slated to be approved very soon! (Sorry, I thought you just filed or something.) Respond to the RFE and you should get an answer from USCIS shortly (60 days, perhaps)
