That is exactly how I filed this years taxes was married with non resident spouse, and did not have to include his income on my return. But CRA is still asking for his income, but I didn't have to include it when I filed the return, that is what is confusing me?

What I was told is that they take his income into account when doing GST rebates even if you don't see any of his money.

Things like this right here is what has me upset.

"The GST/HST Credit is based on your combined net income (worldwide) as a couple. It has nothing to do with your taxes - it is a special credit that Canada pays to low-income people who file their income tax returns. Since you are married, your GST/HST credit is based on your combined worldwide income as a married couple - and they need to know your spouse's net income before they can properly determine whether you still qualify for the credit or not, and if you do still qualify for it, then they need to know if your spouse's income will reduce the amount of the credit that you should have received."

How can Canada justify this. I do NOT and NEVER have benefitted from his income. How can they now penalize me because I am married to him. He has a high gross income but a low net income because of the child support he pays, he can barely afford to support himself let alone support me, so the minute I give them his income in Canadian dollars, I will DEFFINETELY owe all the benefit money back. GST, OTB, and CTB. His income has NEVER helped me or helped support my children. It just makes no sense to me at all how Canada can justify this.

I should mention also that right after I got back to Canada after getting married in Sept, and as part of changing my name, I sent a form into Revenue Canada regarding my marriage. This form needed to be signed by my husband. It effectively updated my status with Revenue Canada.

Xprecious - It's also not clear whether you are already in the USA??

I think they're doing the IR1 process and are at the NVC still.

I just sent a simple statement saying that i was married now. It wasn't signed by my husband.

Canada justifies it because you are a married couple. It doesn't matter if he doesn't give you any money or pays huge amounts of child support. That is the income. They don't care that he doesn't live here either. If you want financial assistance from the government, you have to prove that as a family you qualify. Does it suck? Yes of course it does, obviously with the large amounts you were getting it sucks. But that's why you need to talk to H&R block because this is their screw up and they should help fix it. They should know this.

BTW, net income is not "what's left over after bills or support" it's what's left over after taxes and automatic deductions.

To qualify for CCTB amounts and GST amounts it has always been family net income because it's money for the family. I'm sorry. It sucks.

Would I take his NET from his W2- Gross Income minus his state tax, federal tax, social security and medicare tax? I have no idea how to figure it out from his tax returns(1040). I want to get this straightened out asap, before I move to the US which should hopefully be in two months.

Yes, I took my spouse's income after all the taxes, medicare, etc. Good luck, I'm sure you'll get it sorted out.

Ask him what his take home pay is after taxes. Then multiply that by pay periods a year. Then use the best possible exchange rate so that the dollar value is the lowest.

I used the best exchange rate for the year according to google, and it was fine in 2012.

That's the exchange rate calculator used by the CRA; or give them a call... www.bankofcanada.ca/rates/exchange/10-year-converter/

Thanks. That's the one I used this morning to convert his income over. This is still going to hurt, but not as much as what they've already said I owe. I'm going to owe a little less.

No, they won't take your passport....I'm still in limbo with them over child tax benefits they think they overpaid me, from 3 yrs ago. I've adjusted my status no problem.
