So Process was Officially Started Jan 2nd 2014

So now I am just waiting for NVC to contact me via Snail Mail I take it, while I slowly pack away my belongings

I have a question about Early Work Employment and Advance Parole with Green Card

So Once we get married we apply for AOS, now I am seeing that it takes 120days for AOS to be approved with Green Card in Mail, and the Early Employment at 100Days, so my question I can work and travel freely once I get my Green Card, so why would I pay the extra $400 for 20days of early work

Especially if I can get EI from Canada

The EAD/AP takes 30-90 days from the date on your NOA1. If your case is simple with no RFEs, most people receive their EAD/AP combo card around the 60-65 day period from most of the timelines. The EAD is free when you file with the AOS, it is only an extra cost if you file it separately.

Also AOS will not necessarily be approved that fast, even though you're adjusting from a K-1 visa and may not require an interview, so getting the EAD/AP card would come in handy if your GC process happens to take longer than you expect.

Correct me if I'm wrong, but once you leave Canada, you are no longer eligible be for EI? I could be wrong, but I thought it was based on residency.

Don't wait for NVC to contact you. Call them!!!!

EI is not based on residency. You can get EI in the USA if you moved for a specific reason (relocation for family.) You do have to wait for the EAD before you will get it but you must apply within 4 weeks of quitting your job.

EAD and AP are included in the price for the AOS. AOS can take up to a year (or more.)

Don't bother applying for EAD as soon as you move because it is pointless and only valid until the I-94 expires, and takes that long to get it.

ok thanks for the info, if the EAD and AP are free then I will do it just to do it,

I have to look into the EI again and I may need EAD anyways to apply, the AP I dont really need because I dont want to leave the country until I geta GC anyways

My other Question while I wait for my NVC there is the one paperwork that the embassy package takes you to that creates a barcode I am guessing I dont want to start that until notified I am pretty much all collected up except for the Medical and Getting my Criminal record checking

Thanks for the help, and love the form we have both used it to file out paperwork

You don't need the EAD to apply for EI (you will do that within 4 weeks of leaving your job no matter what), you need it the EAD to collect the EI or else you'll have to wait until your green card arrives. AP is in case of emergencies really... What if someone in Canada gets sick or dies? You'd likely want to be able to travel outside the USA.

Make sure u are reading stuff on k1 and not Cr-1 as they do differ. As others have stated, Apply for Ei right away...but you won't get any $$$$ until you get your EAD. As well After u enter the USA..You can NOT leave until u get advance parole (AP) or the greencard! Not even to Canada! Well u can leave..but u may not get back into the USA!! Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
