dcfed and going to interview next week. i-864 question.

Typing this from my phone, so please bear with my grammatical errors and such.

Here is my situation, I, us citizen, have been living in China since November 2007. I filed my back taxes in early March through the "streamlined filing system for delinquent tax payers abraod" with 2555 forms for to exempt my foreign earned income. This equates to my total income for all years on i864 to be $0.

Now here is my first question. I have no bank accounts open in the US, for the bank account and assets part of the i864 do I put the amount from my Chinese bank accounts?

My father has also filled out an i-864 as a joint sponsor and I have his tax records and what not. Although our interview will be on April 17th and he did not file his tax return for 2013 yet. His records are for 2012 and the 2 years prior to that. He plans to file before the 15th, but due to the slowness of mail he sent us the info with the information as it is.

Does anybody believe that my father's i864 joint sposorship form will be rejected because of this fact?

Forgot to mention basic stuff.

I am a us citizen.

Met my current wife in summer of 2007 while she was an exchange student at the university of minnesota.

She flew back after not being able to reenroll in school because her Chinese university would not release her transcripts.

I missed her so much, I flew after her in November 2007 and have stayed in China since.

Married in Beijing august 28 2008

Worked in Beijing teaching English and physical fitness during that time.

Finally decided to go through the immigration process after visiting america on vacation a few times.

And my wife wants to reenroll in graduate school.

Sent i-130 to Beijing embassy Jan 02 2014

Went through the various steps in between.

(File back taxes, father said he would take us in to live in his home in Minnesota until we are on our feet, filled ds-260, registered delivery to/from local citic bank, sent in extra documents, got all kinds of relationship and biographic evidence together.)

Have interview scheduled for April 17th.

Just looking for info on this i-864 stuff so I can get all my papers organized and ready for the trip to Guangzhou with the wife.

I would not include your Chinese bank accounts, as you have figured out your I-864 is just a bureaucratic exercise.

As for your father's 2013 taxes, they are going to want to see that since you interview after the 15th. Can he not email a copy that you can print out. While the I-864 needs an original signature, the tax returns do not. Even though it sounds like the I-864 will reflect 2010 to 2012 data, they will want to see the 2013. Hopefully, your father's financial situation has not changed much in the last year.

1. did he file taxes with 'married filing jointly' status? if yes, his spouse needs to fill out and sign a I-864A, include it with the stuff on interview day. don't have it on time? expect an 221G about it. easy to overcome, submit, later after interview day.

2. you need a complete copy of a tax return for 2013, filed in 2014. It sucks your interview day is right at the cusp of the flip-over day with the IRS. Did he keep a copy? If yes, hire a teenager to scan all of it into pdf format and email it to you. Although - it's quite possible to get some grace from a Vice-Consul - I remember several getting 'grace' this time last year without that year's tax return.

3. current annual income for 2014 clear on the I-864 ? Clear = NOT FUZZY...

you must prove up and submit the steps and proof of your effort to re-establish domicile in the USA with the I-864. If you will be living with Dad, a letter signed by him explaining this is useful. New utility bills in your name also help to prove up this re-establishment. A job-offer letter is helpful, also.

Thanks Darnell, yes he did file jointly and I do have a filled i-864a from my stepmother.

His current annual income does not look fuzzy to me. It is around the same amount he claimed on his taxes for the years prior.

As for the home, I have a signed letter with pictures of the room set up, and on his taxes it shows his address as the same, and that he is a homeowner.

He uses turbo tax to file, so we can get a copy emailed to us as soon as he finishes.

I sent him an email letting him know that I will most likely need his 2013 tax return too. I hope to gosh he files it before the 15th because with the time difference, we will already be out of Beijing and in Guangzhou by that time with less than 24 hours before our interview. And might have a hard time printing a tax form over there.

I also have a job lined up for when I get back, just did a long distance interview and expect a job confirmation letter in my email box shortly.

yay ! One less thing ! I swear, it sucks being right on the cusp of 'Tax Day', but it's good that you got it all.

The I-864 stuff must have original signature - if time and timing suck on shipping, expect a 221G about it (but it's ok, only a 2 to 4 week delay after submittal after interview day). A scanned/printed version won't be accepted at the IV Unit, alas.

Just want to say that it went well. My wife was aproved. Only thing bad that happened was that my phone broke while in Guangzhou. So typing this is very difficult. I want to thank darnell and lbeachy For their help in the matter as we await my wife's passport to arrive at our local critic bank in Tongzhou district of Beijing.
