Hello everyone on visajourney. I have mentioned this before that I am helping out a friend to process their k1 visa. We will submit their I-129F next week but all of a sudden the USC told me that he has a harrasment charged by his ex girlfriend few years ago. He was told by the court to stay out of trouble for a year which he did. Now my question is, in I-129F part 3 questions 2-3, should we put 'NO" or yes? and what are the documents we need to pass with regards of his misdemeanor? I am hoping you guys can help me out with this. Thank you!

My friend had the exact situation. I'm not sure what they put but they submit the paper they got from the court. I can ask my friend to make sure what they submit if you want me to.

She said that they submit document from the court that related to her husband's case.

during the interview, embassy asked that document.

question 2 and 3 they answered with "yes"

If ever we put "no" as the answer in Part 3 q's 2-3, do you think we will get in trouble for that when the USCIS find out that he had misdemeanor when they do the background check?

Don't lie on the form because they actually know about his case. So be honest. And submit the paper he received from the court regarding that case.

he said he lose the paper he received from court, where can we get a copy of it?

Does he need to include an explanation with regards of his case?

My friend's husband also lost his paper. What they did was they went back to the court and asked for it, the court sent it by mail and arrived in three weeks.

Your friend needs to submit a police report too regarding his case.

Not at all. They didn't ask questions about the case. They only asked the copy of the document from the court.

Your friend needs to get a form called a Certificate of Disposition from the court. It indicates the arrest date, charge, outcome of the charge. They may need a copy of the accusatory instrument which is just the formal written charge and you can get that from the court also.

Some courts actually charge you for them....

Never lie on the form its better to list everything and just be prepared to explain your self.

It sounds like your friend was given an ACOD, or Adjournment in contemplation of dismissal where he behaves for 6 months or 1 year and providing there's no issues it gets dismissed in any case the certificate of disposition will show Dismissed-ACD or Dismissed it doesn't really matter it shows the case was handled and closed.

I think you also need to make sure when you get a copy from the courthouse their stamp is on it. I have a DUI conviction and what I have is a copy of the arrest record notes from the police officer, I also have the court outcome with all the fee's that were applied and showing paid. I think that also needs to be provided but double check that part. I also sent in a letter explaing the conviction and the outcome- fee's what I was charged with my probation and all that good stuff.

Shouldn't be a problem if you tell the truth and provide all the documents for the charges.

Interview 11-25-15 - Denied

New K1 submitted - 1-9-16

NOA1 - 1-12-16 (according to USCIS)

hardcopy - not received yet as of 1-26-16
