Hi everyone,

I130 filled for my parents has been apporved lately. I received letter from USCIS saying that my paper work is transferred to NVC.

However, my parents do not want to go to U.S soon. They do not decide when they want to come yet, but they want that whenever they decide to come, they will take the interview without waiting i130 again.

So, can they just not send the interview application to U.S Consulate now, and will send the application at a later time when they want to come to U.S?

first of all, there is no interview yet. the i130 is only the first form

at the nvc stage there are more forms, payments and documents to be sent until the file is complete for each of them

you can stretch that part up to over a year, sending things apart, for example, make a payment, you will have up to a year to submit the form and paperwork, then pay another thing and wait for a while to submit forms and documents

once they have the interview, usually they have up to 6 months to enter the country

but they cannot wait indefinitely. why file if the don't know when they want to come?

if you don't do anything, immigration will keep the case open up to a year, if there is no movement, the case is considered abandoned
