Hi~ I'm filing the I-130 petition for my husband and we're ready to put it in the mail tomorrow. It's all compiled with its acco fasteners and check and signatures but I'm still staring at Line 21 on the I-130. "If filing for your spouse, give last address at which you lived together"

I am a resident of the U.S. I own a retail store in California and have had the same address / residence for the last 5 yrs. I regularly spend 5 months of the year in Thailand. October, November then return to the U.S and back to Thailand Feb, March & April.

My husband and I share a lease on a home in Thailand. We are using the lease as part of our "evidence of bonafide marriage"

I am at our home in Thailand now and will be returning to the states at the end of April for the next 6 months.

How do I answer Line 21 without it appearing that I am a resident of Thailand? Should I attach an explanation page?

Do I put the last date of my arrival visa in Thailand (Jan. 17th) to present? The lease shows it was started on Aug. 1st 2013 ~ I signed it but wasn't here. Arrived Oct. 1st left Nov 24th arrived again Jan. I'm hoping someone can shed some light on this for me :.) I'm having a really hard time with this. Thank you!!!!

Oh, and although the lease started in Aug.1 2013 of this year, we've lived together in this house 5 months a year for the last 3 yrs. Just to make Line 21 a bit more confusing for me :.)

This means the last address where both of you live together. So after marriage, if you guys have lived at the address in Thailand, put it where they asked last address live together. On the form, they are going to ask where immigrant intend to live in the USA. In that space, put in the address to which you are going to live at in the USA. Hope this help!!!??

Yes, Thank you :.) I have already put our Thai address of the house that we share on Line 21 ~ I'm concerned about what dates to put "when to when" as we've shared the house for 3 yrs. but I'm only here 5 months a year and my residence is in the U.S. I am here (In Bangkok) now returning to the U.S soon. So do I answer Jan.17th to Present ? as this is the date of the last arrival to Thailand on my passport? I have been here 6 times in the last 3 yrs for 3 months at a time ~ then back to the U.S. (to the address I used for my filing address and the address my husband will live in in the U.S) my question is how to answer the Date question part of Line 21. Any more ideas? Should I attach a page explaining our situation?

I don't want to make it appear that I have lived in Thailand longer than six months and have any form of residency here because I don't. I'm on Tourist Visa's and more recently a 60 day extension based on marriage.

If you haven't spent more than 6 months in Thailand, that shouldn't be an issue because whenever you leave the USA, it is registered as to when you left as a PR. As I said, attached an explanation regarding your situation. If I were you, I will enter Jan. 17 to present with detail explanation on my situation.

I am not a PR... I am a U.S Citizen. Thank you for your input ... I am writing my "explanation page now" Is there anyone else on Visa Journey's with experience or a better understanding of how dates should be entered in Line 21 when you split your time between 2 countries. 7 months U.S , 5 months Thailand. This petition is going in the mail today!!!!! :.)

Does this look o.k?

Explanation of Line 21 - I-130

To whom it may concern,

I , Christy (full name removed - VJ Moderation) own a retail store in (city removed - VJ Moderation), Ca. and my primary residence is there at the shop ~ live/ work space. I also share a lease with my husband on a home in (city removed - VJ Moderation), Thailand where I spend 5 months a year. I am in Thailand October & November and then again from the end of January to end of April when I return to the U.S. I stated in Line 21 that I have lived with my husband from Jan. 17th to present because that is the most recent entry stamp on my passport on this trip flying into Thailand.

The lease we are using for "bonafide evidence of marriage" is for this house in (city removed - VJ Moderation). We have shared this house, 5 months a year, for the last 3 yrs. but my primary residence remains the U.S.A.

Best regards,

Christy (full name removed - VJ Moderation)
