My K-1 visa was denied on Feb. 6th, 2014 and I am leaving for Haiti this Thursday to go and marry my fiance, but now I am afraid that I may have purchasde my ticket and I may not be able to leave. I am not sure if I was suppose to wait to be notified in writing or call and close the case and if so with whom NVC or US Embassy in Haiti? I am not sure what the process is please advise soon as possible.

How sure are you that the case was denied and not placed in AP?

There is nothing to inform the US Embassy about unless you get marry. Marriage voids the K-1 route.

If the K-1 was denied, then getting married and filing for the spousal visa is the smart move.

If the K-1 is in AP or a slight delay, then marriage voids the K-1 route.

Figure out what your legal situation is before getting marry.

Thanks for the response, when I contacted the Embassy I was informed that the case was in fact denied. I was also told by my Fiance that he was not approved. The immigration officer did not mention anything to him about the case being placed in AP, by the way what is "AP"?

You may also want to confirm why he was denied. Some denials cannot be overcome by a Spouse Visa.

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

After the denial, I contacted the Embassy and was informed by a gentlemen after providing my case number that our case was denied and nothing could be done to overturn the decision. They were not able to prove that a relationship exist and they questioned his response to the questions he answered. He stated that I would have too enter the country and marry my fiance then file the I130.

I would get that statement from the Consulate in writing via email, then proceed with the marriage and I-130. Sorry to say, the process takes about a year.

I called the Embassy yesterday afternoon just to make sure, I was advised that I could go ahead and proceed with my plans to enter Haiti and marry my fiance.

You need to send a letter to the service center with your petition number on it make sure they have to sign for it and with draw your petition for k-1 print out the letter you sent and proof of sending it showing that they have to sign for it send copy of all that with your spousal petition.............. when it comes time for interview include proof it was delivered unless you intend on waiting until you have that proof before filing for spousal visa.........mine was sent back years ago as expired petition but still had to with draw the petition for k-1 for someone else you cant have two petitions in the system at the same time.......i received a letter from the service center two months later stating that i had with drawn my k-1 petition

make sure you take loads of pics with you spouse also family and doing other things together on different days now you have to build a case showing you have a valid marriage as well as what ever else you can get done showing that your marriage is is a real one...........its going to be an up hill battle since they did not believe there was a relationship between you for the k-1

Hi a few months ago you asked me if my case was in in administrative processing. Well I stumbled across this website today I found that I it has been since April 17. My fiances interview was on February 6th. What does this mean for us, I thought his case was denied.

Hi,

Unfortunately, there is nothing you can do about AP. It can take a few days or a few years. All you can do is wait patiently.

Marriage will not help you avoid AP. Marriage would just void the K-1 path and you would need to start from step 1 with a spousal visa which would probably put the case into AP.

There is no way to avoid AP.
