I know that the K-1 visa is only good for one entry within 6 months of getting it. My question is that my boyfriend and I have had some problems lately, nad we don't want to use the visa. Can he come into the country as a tourist and not use the k-1, and then if we want to, can he use the k-1 a couple of months later? We have until April. This just all sucks! We were so close to being together. After four years of long-distance, he had to mess up so close! Please give me any information you have!

May 2, 2006- Sent I-129F to Nebraska

May 5, 2006-NOA1

June 1, 2006-Transferred to CSC

June 14, 2006-Received letter confirming transfer

June 15, 2006-Touch!

June 16, 2006-Touch!

June 17, 2006-Touch!

June 30, 2006-Received RFE!

June 30, 2006-mailed RFE to CSC (overnight)

July 3, 2006-Touch!

July 4, 2006-Touch!

July 5, 2006-CSC received RFE

July 6, 2006-Received email confirming CSC received RFE

July 27, 2006-Touch!

July 31, 2006-Approval!!!!!!!!!!!!!!! (SOOOOOOOO EXCITED)

August 1, 2006- Email stating we had been approved!

August 1, 2006- worried about what comes next!

August 7, 2006-package sent to NVC

August 8-17-package was received by NVC, processed, and sent to London Embassy

August 17, 2006-Rich received packet 3 from the Embassy in London

August 22, 2006-Rich mails packet 3 back to London Embassy

August 31, 2006-Rich has his medical

September 21, 2006- I received an email from the Consulate with the Interview date

September 23, 2006- Rich received Packet 4

October 18, 2006- Interview! Approved!!!!!!!!!!!

October 20, 2006- Recieved visa in the mail

May 04, 2007-Sent AOS and EAD packets

May 09, 2007-NOA1

June 01, 2007-Biometrics appt.

June 12, 2007-AOS transferred to California

July 16, 2007-Touch (AOS)

July 17, 2007-Tourch (AOS)

July 18, 2007-EAD approved!!!!!!!!

July 27, 2007-EAD arrives in mail

September 05, 2007-Green card arrives in mail

-01/13/07 NVC notice via snail mail

-01/25/07 Packet 3 arrives.

-02/22/07 Packet 3 is mailed.

-03/02/07 Medical

-03/13/07 Packet 4 arrives.

-03/16-24/07 Honey visits.

-04/02/07 Interview(Approved)

-04/10/07 Visa arrives.

He's in the system, hon. He either needs to come over on the visa and you guys see where you're at in 2 months (because you have 3 to get married) OR you need to head across the pond to see him and straighten things out and see what it is you both want.

11/14/2006 AOS packet made it to 'the box' after being overnighted.

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

If you feeling that this is something that needs to be worked out and you are worried about using the K1 Visa right now...then maybe you can go and visit him soon...and then he can come in April...that way you don't have to worry because it's going to just be extra time trying to get a tourist visa now...

Also no one can predict life...and we make this committments not to be taken lightly...and often one party may have messed up something...however, with prayer if it's not life threatening and you all have true faith and love one another it cn be fixed....Time is just for healing...but life is too short....

Take care and remain blessed...In either case you have to make the choice that is comfortable for you...

JAN-10-2007 EMAIL OF APPROVAL FOR NOA2 (Received email 8 times in a row!!!!!)

01-11-07 "TOUCHED"

JAN-23-07 BACK FROM UK-- ENJOYED THE 6 DAYS THERE...

JAN-18-07 RECEIVED LETTER FROM NVC (National Visa Center)

1 WEEK PETITION WILL BE FORWARDED TO THE APPROPRIATE VISA ISSUING POST (LONDON) WHERE INTERVIEW WILL TAKE PLACE....

JAN 24-07 JUST FOUND OUT OVER THE PHONE THAT NVC SENT PETITION TO LONDON ON 1/12/07 & US EMBASSY IN LONDON HAS HAD THE FILE SINCE JAN 17TH 2007

JAN-26-07 HONEY JUST CALLED ME...GOT PACKET 3.... WOW!!!!!!!

Maybe I am reading more into this than there is, but I sense that you are blaming him for something. Get over to the UK and talk face to face, is what I would suggest. Marriage is hard enough without starting out on the wrong foot. Get whatever it is "cleared up" before you go any further. Life is far too precious to feel you have to commit, by marriage, to someone just because the immigration process dictates the timeframe.

Technically, he can come over to the States without *activating* his K-1. He has until the exipration date on the visa to activate it.

That's what I was told by my consulate. But it might be different for the UK.

This is not the case if you enter on a K-1. Once you enter, the Officer at the POE will see the K-1 in your passport and it is "used" the minute you enter the US. There is no way of delaying it's use, by claiming you are entering on the VWP or on any other kind of visa (if you can get one). Once you enter, if you have a K-1 visa in your passport, you are entering as a K-1 visa holder.

The officer who handed me my K-1 visa kept saying that "it is only good for one use; if you're coming to the US on a visit, you don't have to activate it if you don't want to yet--you still have until the expiration date to activate it."

It must be different for Canada then... I guess because at that time, Canadians didn't need passports to enter the US.
