Hello,

My husband who came under K1 visa last nover filed for AOS in Feb when his I-94 was expiring. We did receive the notice of action and he is scheduled for biomatrics in March. My question is will that be a problem that his I-94 is expired now and how long does it take to get his EAD after biomatrics?

No, it is won't be a problem. It is rare for a K1 entrant to get AOS in within the I-94 period, most do file AOS after it expires. As soon as you receive your NOA just carry it with you for your peace of mind. It will be your proof that you have AOS in process. EAD usually gets approved within 2 to 3 months after biometrics. Check processing periods for your area to be sure.

You have nothing the least toworry about. Your EAD and AP if you did apply for one will be in between 60-90days. Once you have filed for AOS, there is nothing to worry of I-94 expiring
