Hello All,

We are finally narrowing in on sending our AOS package and I have a couple questions regarding the i-864.

1) The application only requires tax documentation of the most recent year, which I have provided. However I did not file taxes the two years before that because I was either a student with no income or working abroad and exempt from federal taxes. Will this be a problem and should I include a letter explaining my situation?

2)Since 2013 I have been making several times the poverty level, but I have not yet filed taxes for 2013. My taxes for 2012 report me at about %140 above the poverty level because I only worked for the second half of the year. Essentially, my i-864 reports no income for 2010, no income for 2011, and ~$22,000 for 2012. I have Included pay stubs, bank statements, a letter from my bank, and a letter from my employer indicating my current salary of ~66,000. Is this enough, or do I need a letter explaining this as well?

You are only required to provide a copy of your most recent tax return with the I-864. You still need to list that last 3 years adjusted gross income. If you have not filed taxes in the last 3 years, you need to include a statement of why you were not required to file. You can include pay stubs and employment letter to prove your current income. You don't really need anything from the bank but include them if you wish.

Just a small detail about what Zedayn said above: If you used a 1040EZ, then it is AGI you need to list from the last 3 years. If you used any other form, then it is the Total Income, which is line 22 of the 1040.

OP, if you actually filed the taxes, then you do not need the statement. The statement is required for those that have not filed for any of the last 3 years.

There is no sample really. You just write why you were not legally required to file for whichever year(s) you did not. If you were unemployed and had no income, then say that.
