Hi,

I was officially married to my now wife two weeks ago and we've begun the AOS process. She came here on the K1 and was seen by an official physician before leaving China. She was given a copy of her DS-3025 and a sealed envelope with what I assume to be an official copy of the DS-3025. On her results she received a check by Vaccine History Incomplete with the additional check of Applicant may be eligible for blanket waiver(s)...

Her examination date happened in August 2013 and many of her shots were labeled "Not Age Appropriate". She had only dose 1 of the TD, MMR, and Varicella vaccines. The influenza was not routinely available.

What should our next steps be regarding the submission?

Should we submit the i-485 with the DS-3025 but without the i-693 being filled out by the civil surgeon (not sure if that's even a possibility)? Or should we wait until the forms are complete? Given that there's been a delay of more than 8 weeks since dose 1, would that in general require a new set of doses, starting from scratch? If we go the path of waiting for all of the doses then it seems like we would have to wait up until a year to finish the TD series (and have all doses complete).

Drivers License

While the AOS is being processed, is there anyway to get a drivers license for my wife? From what I've read it seems like you need to have the green card or in some cases the EAD works? If a drivers license is not available is there a way to get a state ID or are we subject to the same constraints as the drivers license?

One one shot in a series is needed when filing for AOS. If you wait until after March, the flu shot will no longer be required. You can send a copy of the DS-3025 and hope for no RFE for vaccinations. If you choose to go ahead and see a civil surgeon, then I would again wait until after March when the flu shot will no longer be required. Get the follow up dosage and have the vaccinations transcribed onto an I-693. Check with your state's DMV. You can probably get a license with the I-94, but it would expire when the I-94 does. Typically you need at least the EAD to get a license or state ID.

if you fill in your timeline and also say where you are you might get an answer from someone who has done the licence thing in whatever state you are in. In Md you can get a licence but it is only valid for whatever length of time your current immigration status is, so I94, EAD etc.
