My wife assumed my Last Name after marriage (it took place in UK). She's not from UK, and her passport bares her Maiden Name. When I filed my petition, I put her assumed name (mine) and put her Maiden Name in place where it asked for 'other names' - it does say including maiden name. My question is: when the time for interview comes and she she will receive her visa, does her passport have to be the updated one (with new Last Name) or using the old would suffice? The reason I'm asking, is because in her country, it is NOT necessary to register her marriage from abroad with the country's Registry Office, but if you need to update your passport, then you will have to do that first. Lots of paperwork comes with that and if it is not absolutely necessary to have your passport updated for the purpose of receiving your visa, then I would be glad. Although, I'm afraid that one should updated his/her passport in such cases. If anyone knows the procedure on this, let me know. Thank you.

I think it would have been better to n put her maiden name because they generally want the name that matches the birth certificate. For our application I used my maiden name for everything. And even though I changed my name legally last summer, I still kept everything in my maiden name because that matched my birth certificate and application. I would say call the visa service center to check...wouldn't hurt :)

I guess, in the end, it would've been easier to do that (leaving her maiden name). Although, USCIS shouldn't get confused in any way, since all the information on G-325 and I-130 matches any legal documents and is self explanatory. Wife's birth certificate bares her maiden name, and so does her passport, but on forms, it is clearly stated that she is married to me and what her maiden name is.

We basically wanted to have my wife to use my name upon entry to the U.S., legally. Green Card and SSN would be given in her new name, and all without the extra charge. However, I did not realize how complicated and time-consuming - changing her passport will be; hence my question on here.

So....if we DO NOT have to get her new passport before receiving visa, then I would postpone the changing of her passport until after her entry to the U.S. Her visa will not be valid anymore anyway.

It was double weird for me. I was previously married and divorced about 6 years ago. I never changed my name back to my maiden name, and kept my married name until I met my (Now) husband. So.... My passport was in my OLD married name, my Birth Certificate was in my Maiden name, and my AOS was filed in my NEW married name LOL!!!! It was NEVER questioned at all through the whole process EVER. It was never brought up at my interview, and even when I supplied my Birth certificate passport and EAD to apply for my SS# it caused no problems. In other words? Your fine my friend... and I see we are kinda from the same neck of the woods in terms of location? Good luck, you will be fine.

P.S I have received my Green Card which is in my NEW married name, and have been told that It is fine for me to travel out of the country and use my passport with my OLD married name as long as I have my marriage certificate on me.

LOL! Yes I think you got it all right... to clarify...

1, My birth certificate is in my MAIDEN name

2. My Passport is in my OLD married name

3. I filed my AOS in my NEW married name

Because my visa is different to the one you and your wife have applied for I will throw it out their to other VJ members to advise if the visa in your wife's married name is fine in a passport that bears her maiden name.... but I would imagine the majority of people will still have their passport with their maiden name in it by the time their visa's are affixed into their passport.

Right, that's what I'm mostly afraid of - that they might not want to affix the visa (clearly, it will be issued in her married name) in the passport which is in her maiden name. Your visa must have matched, because your passport was already in your married name. Thanks for all the info ;)

No... My passport is in my PREVIOUS married name, my Green Card is in my NEW married name (I have been married twice). My Passport and Green Card have 2 different names.

That is one of the reasons of asking for any other name used; so if there is inquiry with the "wrong' document, all other names would come up and it all would resolve

True, but I just want to make sure of one thing: when my wife goes to her interview and hands over her passport (with maiden name) for the purpose of having visa affixed, the consulate employee isn't going to reject it and tell her she needs to bring her updated passport. That would not be a good thing, for it would lengthen everything.

To be on the safe side, I'd suggest checking with the Embassy/Consulate that will actually do the work, as they all seem to have their own procedures. The Warszawa Embassy are super nice to work with. Don't have experience with London though.

I received my Green card 13 months after I got re-married
