I'm in a bit of a special situation.

I got married to my wife in August of 2011.

She is the USC and I am a Canadian citizen.

I accepted a job in the US on an L1-B visa in March of 2012.

I followed all of the instructions and I am using my income (the intending immigrant) as my wife is a student with 0 income.

I believe my income can be considered as it is legal income in the US.

I asked my companies HR if they would apply for a renewal of L1-B for me, they said they would if my GC attempt fails.

With my wifes i-864 i sent my last 6 pay stubs, a proof of employment and my W2s for 2012 and 2013.

I am still waiting for a letter from the companies attorneys stating that my employment will continue after my l1-b or GC.

Some people have mentioned on forums that this might be a case where I can get an RFE.

My question is, we have plenty of family members that are willing to co-sponsor.

Should i have them send an i-864 even if my packet is already in the mail, or should I wait for an RFE?

When does your current L1-B expire? They usually need to be renewed every 2 years so hopefully you have had at least one renewal.

Do you mean you accepted a transfer from your Canadian based company to the US? You can't (legally) get a L1-B by just applying for a US based job, it has to be an intracompany transfer.

Did you also send your tax returns or transcripts for those years? If not you will get a RFE on that for starters. I would line up a joint sponsor and have that paperwork lined up just in case, you should also get the continuing employment letter from your employer.

I am on year 2 of my first 3 year L1-B

I did transfer to a US job for the same company ( i have been with them for 7 years)

My first year of filed taxes in the US was 2012 (filed jointly with my wife)

The 1040 tax return was sent for 2012 along with the W2 for 2013 (no 1040 yet)

at what stage should I expect an RFE if any?

They issue them for 3 years now? That sure would have made my life easier when I was on one.

You should be good except maybe for the letter of continuous employment , so I'd get that in case you need it, it may not be needed right up until the interview so it would be good to have regardless of whether you get a RFE or not. However don't and them anything further that they haven't asked for.

I would not send in another I-864 until you get an RFE. Sending a second package before an RFE won't speed anything up and it might just be confusing for your file.
