Hello!

I am Jae, and I am from the Philippines. Here's the thing:

1. My husband and I got married in Dec 2013.

2. We have filed I-130 and I-129F in the hopes of applying for a K-3 visa. Status are as follows:

20 Feb 2014 - I-130 packet sent to Phoenix Lockbox facility.

26 Feb 2014 - Husband received I-797C (NOA1?) by mail.

03 Mar 2014 - I-129F packet sent to Dallas Lockbox facility.

3. My husband is in the US Army, but is currently on Reserve Duty. He'd been deployed twice to

Iraq in 2008 and 2010, respectively.

Now, we wait. I've been reading a few forums here, and I must admit that I was disheartened by what most users say about K-3 visa application. My question are as follows:

1. With the current trend on K-3 visa application, what do you highly recommend?

2. In relation to item #1, and based on our status,

is it still possible to change our minds re: K-3 visa application?

3. How true is it that a spouse of a US citizen is automatically issued a visa number, an advantage over those who are only in Legal Permanent Residence status?

Any thoughts ans/or recommendations are highly appreciated.

Thanks,

Jae

My husband was also served active duty in U.S army. He was deployed in Afghanistan before. Currently he is also on reserve duty. You live in the Philippines, from what I heard they expedite the Philippines beneficiary due to yolanda. If you live in those areas affected of the typhoon your hubby can apply for expedite.

Hello, islandgirl80! Thanks for your reply.

I've heard about it, too; however, I don't live in any of those badly hit areas to have my application expedited. sad.png

Hello, marian630! That's our predicament. Most responses I have read elsewhere say the same thing about K-3 visa. We're still at initial stage of the petition, so I guess we can still change our minds about applying for K-3 visa. It looks like we have about 4–6 months to decide because I-130 usually gets approved around this time.

I'm sorry I can't help with your queries below, except for item #3, I've read somewhere that victims of Typhoon Haiyan/Yolanda are eligible for expedition. That is, of course, subject to further investigation. Supporting documents must prove that you are, indeed, a resident of the badly hit areas.

Thank you for your response!

I am in the Navy married to a Filipina. We got married in the Philippines but I chose the K-1 Visa because in doing research I saw it was quicker. When we got stateside we just had a civil wedding to make it official for the US. I sent off the application in OCT 2013 and she had her visa in hand by JAN 20. Not sure if you can re-file as K-1 but it might be worth looking into. Good luck!

Hi, jjroper. Thank you for your response; however, I will have to agree with li_09 because I'm already married, so K-1 no longer applies to my case.

Hi. I suggest CR1 since you are already married. The priority date doesn't really apply to USC Spouses at least that's what the NVC told me. I suggested CR1 because you are a military wife. You can apply for expedite processing. We sent our I-130 last September and I'm already scheduled for a visa interview this coming April.

Hi, ann227. Yes, we're looking into that. We're still waiting for NOA2 for either of the two petitions, and that's all we can do for now. Thanks, by the way.
