hey guys!! just curious as to if any of you were denied previously with a fiancé visa and decided to do the spousal petition. we never got anything stating why we were denied so i have mailed in paperwork for the freedom of information act. until hearing anything from them i am focusing on returning and getting married and moving forward with the spousal petition. was curious as to if you guys front loaded with forms and reports and etc etc... i am OCD about organization and i plan plan plan so I'm getting ahead of myself and asking questions early so that i know what I'm getting into and what to expect. hope you guys have an amazing weekend whether you are with your loved one or far apart, alhamdulillah for Skype and the internet!! :-)

It Happened the same things for us .They did not denied our petition they gave us 221g Paper for further process then sent mail to us saying our K-1 is expired.Now we are Married my wife did infopasss the lady who work in uscis local office did not unnderstad why they did not approved our visa in Morocco.Anyway go ahead and marry your babylove.Congratulation .

Oh my gosh, you've been waiting almost a year for your NOA2. I'm sorry :(

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Well we were denied via phone. After his interview they kept all paperwork and passport then two months later got a phone call saying we were denied and case was mail back to USA. That was in DEC and have yet to hear anything further. I know how case is probably expired so we are focusing on that information I requested and moving forward :-)

As you know we were also denied the K-1 ad went on to file for CR-1... I front loaded ours

My husband and I filed for I-129 and we were denied due to incorrect paperwork, but they wouldnt let us bring it the next week they gave us a 221g. Then told us we could use the same application and just start the 6 month wait over again. That was the plan so I waited and waited called USCIS they havent received our petition. Called some more and some more and then call the embassy some more and more THEY NEVER ANSWER! sent an email! a very long email. AND LOAD AND BEHOLD....they still had our case (HORRIBLE) it never left casa 2 months later. So they gave me a number that I could track it with then they sent it. Still hadnt herd anything and no one had it at USCIS something was wrong with the tracking number.

We decided we will never hear anything on this petition again. We really didnt want to get married yet, because we wanted a big wedding where all my family could go to morocco. So we filed again. Along with our NOA1 we got our expiration letter from our first petition. They magically found it. Then they sent us a RFE, but it didnt even make sense. I went to a lawyer and they suggested we just get married now and file cr-1. That's what we did and we have been waiting since october. Inshallah everything goes smooth. Just hoping they are not upset we didnt have some big wedding, but we plan to summer 2015. We wanted to wait until my parents would be able to come.

Sorry for the long rant and incorrect grammar and spelling. Good luck you will know what to do. I know about the planning bug, but its impossible with this process (is what I have learned)

Front loaded means to include as much supporting evidence as possible... even stuff they dont ask for... any and everything that you can come up with.... think of that proves your marriage is real... Your marriage has to look believable on paper.... they dont care how much you love each other or how badly you want to be with one another

Hi moving forward sounds like a positive way to go....but how can you overcome a denial when you dont have the reason(s) of WHY your K1 was denied.

When going through the process here on VJ I was educated by ....I think Darnell, Frontloading is in the beginning when you first start the process of your CR1 application AND sideloading is including more relationship evidence with the DS-230 IV package sent to the NVC.

Normally your fiance should have gotten the 221 with the reason of denial.

221(g) is issued to beneficiary at conclusion of the interview stating the application and/or petition is being returned to the United States.

Petition is returned to the United States by the interviewing consulate for "further review" in what is called a diplomatic pouch.

THIS is the missing part with our experiences from CASA and K1....

Local service center sends either a NOID (Notice of Intent to Deny) or NOIR (Notice of Intent to Revoke) to the petitioner also asking for more proof of the relationship, many cases have specific consular objections to rebut.

Petitioner is given 30-60 days from date of NOIR/NOID (depending on the service center) to respond with additional evidence of the relationship or other specific evidence. The timeframe to respond will be provided in the letter.

Local service center receives evidence...if in the timeframe given (30-60 days) the case is reviewed and either reaffirmed or denied.

Somehow THEY just go straight to the notice.... "since you have not made any action on your case it has expired" letter.

It is a long journey and with your plannings dont forget to REALLY become familiar with each other. Spend more time building your relationship then building your case. It can be easy to become caught up with the Visa struggles and not see signs that you two really dont know enough about each other yet, to move on with a CR1.
