Hello,

We received RFE for our I-751 form. One of the documents that we are being asked to provide are copies of utility bills such as telephone, gas, electric, cable, internet, etc. or other statements in both names indicating residential address.

My husband has contacted our electric company, our cell phone carrier , and our apartment complex and was informed that only one name can appear on those utility bills per those companies policies.

We want to attach those bills along with our joint checking account statements showing that those were paid from our joint account. We also want to include this explanation in that section. However we are not sure if should include this at all since we can provide other proofs such as as 2012/2013 signed lease documents, doctor bills, checking saving account statements, health insurance, car insurance, driver license, tax returns for the past two years and newly received W-2. We don't want to sound like we are making excuses in the reply to this RFE, but on the other hand they mentioned it and it is not our fault because those companies will only display one name on the bill either the primary holder of the account or head of the household. Should we send these or not? Thank you

Note regarding electric, phone and rent bills

My husband has contacted our electric company (Name of the company), our cell phone carrier (Name of the company) and our apartment complex (Name of the company) and was informed that only one name can appear on those utility bills per those companies policies.

My husband is the primary holder on those accounts and I am secondary, therefore only his name can appear on the final bill. In case of our rent bills which also include water, trash and sewage, only the name of the head of the household can appear on the bill. My husband is designated as the head of the household on our lease and therefore only his name appears on our bill for rent.

I have attached copies of those bills along with bank statements showing that payments for those bills were made from our joint accounts.

I was advised by customer services to also provide customer service number to each company with account numbers for verification purposes:

· Our Electric Company (Name of the company) Account# XXXXXXXX and their customer service number is

XXXXXXX

· Our Cell Phone Carrier (T-Mobile) Account# XXXXXXXX and their customer service number is

If I were you, I'd include any bills that do include both of your names at that address. They're trying to determine that the two of you live in the same house.

Could you get a copy of the lease that has both of your names, rather than a bill that only has his? I just don't know if what you have (good letter, though!) will really tell them what they want to know. I don't think it matters too much what the mail is about, just that it includes both of your names, at your address.

Maybe include both.

Yes, I have copies of our 2012-2013 lease and our newly signed 2013-2014 lease. Some mail has my name and our address and some mail has my wife and our address and my electric company, phone, rent companies will not send us bills with both names.

Here are documents with both of our names on it:

- Copies of joint rental leases showing joint tenancy signed by me and my husband for year 2012/2013 and new for 2013/2014

- Joint checking/saving I printed statement for every month from 2012 and 2013

- Car loan with both of our names on it for the newly purchased car in November 2013

- Copies of drivers license

- Copy of our final account statement and move-out statement from our previous apartment complex

- Copy of an invoice from our initial business consultation from 2013

- Copies of our renter insurance policies for 2011/2012 and 2013/2014

- Copies of doctor bills (there is my husband's name on the address but right below it says claim for me (spouse) with all of our insurance information) those are explanation of benefits

- Copies of our car insurance cards

- Copies of our health insurance cards

I also want to attach these documents however they don't have both of our names on them, but all of them show the same address.

- Copies of my monthly school tuition receipts and 2013 Tuition Statement Form 1098-T from April 2013 to September 2013 along with credit card statements showing tuition payments for each month (credit card is in my husband name)

- Additional copies and descriptions of photographs from events during our marriage

- Copies of our rent bills and statement with a payment from our checking account QUESTION MARK HERE IF WE SHOULD, my company will only show one name

- Copies of our electric bills and statement with a payment from our checking account QUESTION MARK HERE IF WE SHOULD,my company will only show one name

- Copies of our cell phone bills and statement with a payment from the credit card account QUESTION MARK HERE IF WE SHOULD, my company will only show one name

Utility bills would not carry as much weight as bank statements, DL showing same address, lease/title documents, insurance, taxes.

They not only are not only trying to determine you live in same place but that you have financial commingle...that is, you are putting $$ on the line to demonstrate bona fide

From you response, I guess we won't include utility bills with the explanation even though it is the honest truth. Anybody can call our companies and confirm that my wife is also on the account, but only one name can show on the bill.

I believe that including bank statements with all transactions for the past 2 years (I did not include all statements in the initial packet but only for the last month and it was a mistake on my part) along with everything else I mentioned above will be sufficient. The stack of papers will weigh at least a 1-2 pounds smile.png

Yes, we are also getting ready for ROC filing in a few weeks. You will be ok.

The only 'utlity' that will have both names is the cell phone bill, in the description of services.

Additionally, if you have some travel together, itineraries or boarding passes besides pics; copies of CC with both names, etc.

As I said, I'm sure you'll be ok.....

They don't, now you just have to wait.

I sent my RFE last week on Monday and according to the post office it was delivered on Thursday.

Does the USCIS send a notice when they receive RFE, like a NOA ?

Just checked the status of our case and the following message is displayed:

"On March 3, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you."
