OPT about to expire, what to do next?

Timeline

F1 OPT about to expire (June, 2014), I-130 approved, PD 4 Nov 2013 (rest of the world). I can't extend my OPT, can I be a F1 student again? ( can't find a job either). Will they approve F1 visa after I filed I-130?

I130 based on what ? we need more information! the only solution you have now is to go to school again, other wise you need to leave the country. even if you have I130 you can get a new I20 when you enroll in a program. However, if you leave the country and you will need a new visa then it would be harder to get F1 visa while you have a approved I130.

Notice that, an approved I130 doesn't give you any status in the US

day 77-- 06/26/2012-- interview / approved on the spot.

day 86-- 07/05/2012-- Received my GC in the mail.

ROC

day 1 -- 04/07/2014 -- ROC Package delivered to VSC

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received

You will need a new visa or have to leave the country. Having an approved I-130 does not give you the right to remain in the US. Since you are the relative of an LPR you cannot file to adjust status from within the US unless you are currently in a valid status. Your best bet is to try to obtain/renew student status while you wait for your priority date to become current.

Thanks for your replies, I will apply to a new program to renew my F1 visa.

Be very cautious with this. You were admitted as an F-1 student for "Duration of Status" -- that is, for as long as your program of study lasted. Your finished the studies (including OPT) -- just get accepted and enrolling in a new course of study will not necessarily legally extend you in F-1 status. You need to be sure that you remain in status, since time out of status is not forgiven for LPR AOS.

if you enrolled in a program that will issue a new i20, then you will have a status. hopefully in 6 months, your PD will become current and then you get your GC. Currently, the Visa quota is stuck for People whose PD 08SEP13, it has been like this for some time. Again, the visa has nothing to do with your status. your status is your I20. when you enroll in a new program you need to STOP working, even if your OPT is still valid. Good luck
