My sons obtained their US residency in 2010. My husband who is a US citizen was the one who petitioned them from Philippines. They are now 22 and 20 yrs old. They live here in US for 3 yrs and 6 months straight, then went home in Philippines for 5 months and now theyr back in US. My question is, " When can they file for US Citizenship?" How long they have to stay as permanent resident before they can file for citizenship? Please share if u have the same experience.

thanks

Did you apply for citizenship? If you did and your kids are younger then 18 they became citizens once you became a citizen. If they are older then 18 they have to wait 5 years before they apply for naturalization. That 2015 is when they are eligible to file. Good luck

Thank u silkafi88, yes they were over 18 when i applied citizenship.

Can they still apply in 2015 even if they went back to philippines for 5 months stay there? but they are back now here in US.

The 5 month stay should not interrupt their continuous residence, but things will generally go more smoothly if there are no more than a few long trips in the 5 year period. You should especially avoid trips longer than 6 months.

They shouldn't have any trouble applying in 2015... 90 days before the 5th anniversary of the Resident Since date on their green cards.
