I was considering including our Pre-nuptial aggreement in our I-751, just wondering whether this might be good or bad, has anyone ever done this before? I have property along with stocks and mutual funds which I hold separate in case something was to happen to our relationship. Any thoughts on this?

This is what I have planned on submitting so far:

We are enclosing the following:

Exhibit A Application documents and fees

  • Application fee-$505 and $85 for bio metrics for a total of $ 590
  • Form I-751 completed and signed
  • Copies both front and back of permanent resident card
  • Supplemental form showing additional residence for question # 22

Exhibit B Tax Returns

  • Copy of our joint US Federal and State Tax Returns for 2011
  • Copy of our joint US Federal and State Tax Returns for 2012

Exhibit C Proof of current residence in California

  • Copy of California Drivers License
  • Copy of the most recent Comcast cable and internet account.
  • Copy of the most recent PG&E bill.
  • Copy of most recent pay slip showing her residence in San Francisco
  • Copy of original social security card receipt showing her residency (original available)
  • Copy of IRS notice CP565 assigning an ITIN showing her residency (original available)

Exhibit D Financial documents demonstrating joint accounts and ownership

  • Copies of our Joint Secure Checking account
  • Letter from showing joint checking in good status.
  • Copies from 3 mutual fund companies showing beneficiary for xxxxxx

Per bolded part above, Just curious, are you sending a copy of AR-11 or i-865 for the address change if you filed those when you moved?

Or what exactly do you mean by supplemental form?

Pre-nups are notoriously weak and relatively easy to invalidate/get around.

Better would be to spend the time/money on some estate planning - a trust to handle those pre-marital assets you want preserved - and a detailed will with a lawyer/banker/impartial party as executor to ensure that your wishes are carried out precisely. These are more secure methods of preserving assets and have a proven track record of withstanding legal challenges. Any of these can be modified as your situation changes over time. Pre-determining allocation of property, including income, acquired during marriage is most often unsuccessful … equitable distribution of marital assets is more influenced by the specifics of the break-up of the marriage.

There may also be some nice tax advantages as well … would recommend consulting with both an estate planning attorney and a tax attorney to flush out the full array of options for your situation.

Married or not, this is a good exercise to go through as we get older and have accumulated wealth.
