household size 100% guidelines 125% guidelines

2 $15510 $19387

3 $19530 $24412

My friend he (his household is 2, he & his wife) want to be my co-sponsors, his 2012 1040 income is $18650 his 2011 1040 income is $20250

My wife she apply AOS for me in US, but my wife and I both don't have income. Can my friend use his income be the co-sponsors to help us?

Your friend will have to prove income for a household size of 3 people (your friend & his wife & you)

So check the 125% for a householdsize of 3.

So check the 125% for a householdsize of 3.

If the friend who is cosponsoring a wife that is 2 (both himself and her). Counting the 2 he is cosponsoring for that makes it will make 4 if there are children or any other dependents they should be accounted for as well.

household of three has to be 24,412 according to the poverty line. His income is below that amount.

Household size would be 3 (friend +wife+you) so no, with an income of only 20k thy oudnot make enough. You will have to find another co-sponsor...

If I count correctly your friend is married that makes them 2 people and you and your wife 2 more that makes 4. Any of you have dependents (children) if so they need to be counted in the household as well. Regardless, unless your friend has some assets which he can include it doesn't seem his income will be enough to sponsor you. If your wife can get a job to supplement the equation, I say you might want to find another cosponsor to assist you with your AOS. Good luck!

His friend doesn't have to sponsor the Wife, only the op, so the household size is 3.

Hmmm It is my understanding all parties involved in the petitioning should be accounted for. I suggest that they look into the guidelines for further details or call the USCIS for clarification.

No need to call.. It is really quite clear. The co-sponsor only has to sponsor the immigrant... NOT The wife, who is the primary sponsor, she does not have to be sponsored financially... She is a resident/citizen in the USA ... So if there are no kids, then the household size for the co-sponsor is 3... And unfortunately based on the income amounts provided, does not make enough...

That would be the very first time I hear of that actually. Uscis wants to see that the beneficiary won't become a public charge in the future. His wife is still a us citizen and can apply for food stamps, welfare and what not for herself.
