Timeline

At this point if I were filing tomorrow, should I just use 2013, 2012, and 2011 Income?

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

There is current income and tax return figures in two different sections of the form.

Your most recent three tax returns are 2010, 2011, 2012. After April 15 (tax filing deadline for 2013) then 2013 becomes most recent. If you have already filed 2013 before the deadline, then it can be used.

But the income reported should be right now, 2014....what do you make today carried out to a year's worth?

Thanks, I was referring to Part 6, boxes 13a, b, and c, the total income reported on Federal tax returns. I just didn't know if at this point they'd want 2013, 2012, and 2011 or 2012, 2011, and 2010. Box 5 I put my current income.

2013 taxes are not required until after April 15. So if you are filing now, then the required is only 2012, 2011, 2010. That said, if you have already filed 2013 taxes, you can include it along with your 2012 and 2011 taxes.

Since your timeline says you entered the US last Nov., and you mention the I-864, then I am going to assume this is for AOS.

I gave them my 2013 this past week and we got our k-1 approved. I brought my 2012 & 2011 but they only needed the most recent. Spent 5 hours at the consulate in Montreal and they only brought us up twice for a total of 5 min. Seemed like they were happy to see the 2013 as she said "Oh great you have 2013"

My wife only has her most recent year of tax transcript ('12 to '13) before that she wasn't really working as she was a student and her last jobs were longer than 3 years ago. She has had a full time job now since September and is well capable of supporting me and far exceeds the poverty line.

Is this going to be a problem at all? Would the most recent year transcript along with other information (work contract stating salary, w2's) be sufficient? Or does she need to get the 3 years worth of transcripts?

Have you read the instructions for Form I-864? I think it answers your questions pretty well.

To correct and clarify better, before her current full time job, she was a student and held a part time job (working at the university) during her studies there. They were not enough to exceed the poverty line at that time obviously and I believe the taxes she filed those years will reflect that. Are those previous years gonna be an issue for filing even though she is now able to support me? Will we need to have a co-sponsor to get through?

Okay, but her most recent tax transcripts don't cover her current and qualifying employment. Will supplying the most recent year transcript along with her work contract (shows salary aand proof of employment) and paystubs for her qualifying/current job suffice? It doesn't say anything regarding those.

The one tax return submission is required. If it doesn't reflect her current income (it doesn't because she didn't work the whole year) then prove her current earnings with those things you mentioned. She tells her current yearly income in Part 6(?). Not looking at the form now.

If you have not filed for 2013 yet, then 2012 will be your most recent. You will list the information from 2010, 2011 and 2012 and provide a tax transcript for 2012. For your current income happening now in 2014, you use a letter from employer and recent pay stubs. If self-employed, you may wish to file your 2013 taxes first, then use the transcripts from 2011, 2012, and 2013 for income proof.
