My husbands green card was approved in October 2012. Now we are looking to bring his two daughters from Haiti as their mother is not able to care for them. I understand we have to petition and I am checking all of that out now. We are also filing later this summer for removal of conditions on his green card (marriage under 2 yrs) so will we have to wait until his conditions are removed and he petitions or can I petition for them as my step daughters? And if so, even if I petition, do we still need to wait until after his removal of conditions? We would love to file ASAP so they can hopefully be here to start school this fall (if it can happen that fast)

There is nothing to stop you from petitioning for them now as the step-parent of both children, provided they were under 18 on the day you married.

Thank you so much for your quick reply. Yes, they are both under 18 (10 & 7). We have been sending money weekly, but their mother says she is not able to care for them anymore and we worry for their well being. So I will get this filed right away and pray it doesn't take too long.

Unfortunately it will be around a year, as standalone I-130s are a little backlogged right now.

You will need two separate I-130s, one for each child.

Yes, it is unfortunate that the wait is so much longer. I honestly had no idea just how much longer until recently. We were just at our interview and were sitting next to someone who's parent/step-parent had been petitioning for them. Because of processing delays and a couple missed/lost documents, etc, etc. (not too clear on why it took so long) he was finally approved on the day we met him!! After an agonizing 3-year wait!!!! He was 14 years old and soooooo happy when they said yes! We got two thumbs up with a look of shock on his face. It was priceless. Anyway, his is not the only one I've heard of taking 1+ years so be prepared for a bit of a wait and if it is faster, all the better!! Sending many prayers your way that they are able to hurry it along for you all and that you are reunited in record time!! <3

((On a side note, we petitioned for my fiance and his daughter at the same time. His situation is somewhat unique so fortunately she'll be here when he is and I am beyond excited!!!))
