Hello!!

Applied for crba on 20 november 2013 in ukraine. Consular asked me to bring more evidence that i lived in us. (She told me - oh, we know thats a problem to prove it for us citizens) Still waiting that my friend send me any paper of evidence.

Crba on hold for 90 days? Is that correct?

I'm us citizen naturalized in 2005, LPR since 2000.

My wife is ukrainian with b2 visa.

We've got married in ohio while we were on holidays in may 2013 and got back to ukraine.

Most likely, i'll be denied crba. And my questions is - next steps?

Apply for ir-1, ir-2?

For now we're ok with my us citizenship and wifes ukrainian, but for child is better to get usc)) in near future we dont plan to move to us. But we will trip 2 or 3 times per year. As a spouse of USC she has to have IR-1? And for child i need to apply IR-2 and then in us change to citizenship?

Thanks!

They keep the case open for 90 days. You do however can extend the case processing time as long as you need.

And my questions is - next steps?

If you plan to move to the US in the not too distant future, I would recommend doing IR process for your wife and child at the same time. If there are no intensions on moving, you can file an I-130 with all needed documents to get your child a green card and use the Child Citizenship Act to get her a USC. The process can take anywhere from 3 months to a year and costs around 1-2K$.

Most likely, i'll be denied crba.

Same thing what happened to me. Maybe this post on how I got citizenship for my daughter can help you here:

http://www.visajourney.com/forums/topic/431566-our-story-crba-for-our-child-denied-entering-the-us-with-a-baby-transportation-letter-and-citizenship-through-the-cca/

Remember that, time spent as a LPR in the US count as physical presence too, even if you weren't a USC at the time.

thanks! i've read it before post here, thats why i said about deny. you showed a lot of papers and they denied((

yep, i know this, but they say to bring more papers. naturalization is only 30 month of physical presence.

I am a naturalized citizen also. In my case I submitted a copy of my social security statement and a letter from my employer. Granted I have been working at the same employer for 10 years and have been residing in the US for 20 years. The consul looked at the documents when I brought them in and just looked at them and immediately looked at me , smiled and said "Well you definitely meet the requirements of physical presence "It was approved in less than 5 minutes. The passport and CRBA was ready for pickup 9 days later. This was the embassy in Trinidad and Tobago. at Port of Spain.

Oct 1st 2012 - Mailed I-130 package to Phoenix
Oct 3rd 2012 - Package delivered
Oct 9th 2012 - NOA 1
Dec 12th 2012 -Case finally visible on USCIS website as initial review
Jan 31st 2013 -Emailed ncsc-customerconnect@uscis.dhs.gov
Feb 6th 2013 - Response that my case was tranferred to the local Jacksonville field office on Nov 19th 2012
Apr 2nd 2013 - Infopass. Found out that there was an RFE dated Dec 19th that I never received.USCIS website never reflected that either.Got a copy of the RFE .Time to make another infopass to drop documents off at local Jacksonville office.

Apr 29th 2013- Dropped off RFE documents at local office

May 7th 2013- Got text that petition was approved.

If you meet the physical presence requirements the CRBA is a pretty straight forward thing and can be over within less than a half hour. If you don't meet them, your pretty much screwed and have to use the Child Citizenship Act to get USC for your child.

Finally i managed to prove my physical presence in the US!!! i brought like 70-100 pages))) my bank statements, my job paychecks. couple of my hospital records, letter from employer, letters about my appartment rent, copy of driver licences for all years, vehicles registartions and titles, couple of envelopes with my address. Original naturalization certificate which already proof that i have 30 month of physical presence before i became USC. there were papers for 10+ of presence.
