we were married in july 2009, we came here together in jul 2011 about 10 days before our two year anniversary because we were in the middle of the problems going on in the middle east and every day counted for us.

my husband and I have a interview next month for i751 after filing in the spring and a subsequent rfe. so far i have sent bank statements, joint car loan, car insurance, apt lease in both our names, utility bills, pics. we didnt send tax returns because I couldnt find a copy. now i know you can order them from irs and i have done that. our son was also born since then and we have his birth certificate with both our names on it to bring to the interview.

there is one thing which is worrying me which is for part of his 2 years living here he was working under the table. actually his employer took his ss number and was supposedly withholding but never sent w2 even after we contacted the irs. so i filed our taxes jointly but only showing my income because we didnt know how much his was. but we did deposit his payments into our account (from 300-600$ approx every week/2 weeks but with little regularity, for approx 8 months) now i think this will be a problem for our interview. hes working now and has actual pay stubs and reported income with direct deposit (for the past year).

what should i say if they ask about his past jobs? Should i try to amend the tax return before the interview (also hard to do because I'm stll waiting for the tax returns from the irs and they might not come in time?

If you have an IRS nearby, you can also walk in and get transcripts. As for amending, it is most likely more of an issue if he plans to file for citizenship than it is for the I-751. Just be honest no matter what they ask. I would really try to get the tax transcripts for the interview, amended or not. Joint filing is an important evidence piece.
