Hello to everyone smile.png

My husband and I were married in Egypt back in 2007 and I lived with him in his country during our marriage. We had a child together and lived just like a normal family. After several years of marriage we had some marital problems and we decided to divorce. It wasn't easy to arrive at that decision, but we felt it was better. We had the divorce process at the Ministry of Justice in Cairo and we each got a copy. After that I traveled back to the USA with our son and that is where I now live. My ex and I still keep in touch due to our son and recently we have started thinking of getting back together and giving the relationship and marriage another try.

I would rather have him come here than for my son and I going back to Egypt. Of course, since we are officially divorced I cannot sponsor him as a spouse. So I was thinking the best thing is to do the fiancée visa. I understand that for the fiancée visa the people have to prove that they have met . In our case that is not a problem. We have several entry and exit visa stamps to travel to Egypt, our many pictures as a couple, with our son, and with extended family, and being married and living together in Egypt.

If I understand correctly...with a fiancée visa the immigrant fiancé travels to the US and the couple marry inside the US and then adjust status so that I wouldn't have to travel to Egypt to do the marriage process there again. Right?

What I would like to know is would our divorce cause a problem to get a fiancée visa approved? I mean that fact that we were previously married to each other, then divorced and wish to marry again?

I have several other questions, but this is the first. smile.png

Thanks in advance. smile.png

As long as you have been together in person within the 2 years prior to filing the I-129F, then you can. When it comes time for the K-1 visa interview, your case might be scrutinized a bit more because of your situation, but all you need to do is prove your relationship is real and valid. It seems like you should be able to provide enough evidence of that. Good luck!

Some other things....

Would the that we did divorce in Egypt be valid in the USA? It was given by the Egyptian Gov't and it is in Arabic. I was looking through the k1 forms and things that are needed and it says that those people who have been divorced must present those papers. Would we need to that well .... I mean send copies of our divorce too even if we will marry again? Would it have to be translated or not?

Thanks
