Taxes and Co-Sponsors

Hello,

I am wondering if the fact my husband has not filed his taxes for the last two years (he doesn't owe anything, he just never filed) him sponsoring me? He has the funds to cover the poverty guidelines, am wondering if that will get him approved? Or should I send in a Co-Sponsor form?

I'll use my sister in law and that won't have any affect on my chances of getting approved?

If your husband didn't make enough taxable income he can send in an explanation . IF he should have filed he needs to do so now and pay the late fees and any penalties that may exist. He has to show his income and your primary sponsor.

If your husband doesn't meet the requirements you can have a co sponsor

No matter what your husband is going to have to file taxes if he was required to do so. Doesn't matter if he owed they owed him, he needs to have the last 3 years filed or a reason why he was not required to file (ie: he was unemployed and didn't make enough money.)

Also If he has enough in assets then you do not need a joint sponsor.

The reason I say this is because no matter what you do, your husband must file an I-864 (or I-864ez) as your primary sponsor. The petitioner is always the primary sponsor.
