Lost Tax Returns

Hey Friends,

I have to file I-864 and I am missing the tax returns for the recents years. In some cases, the transcripts of the tax returns are accepted. However, since I had some business income and had filed schedule C, I think the transcripts won't be accepted according to I-864 instructions. Is that right?

Now if I order my tax returns from the IRS it might take upto 72 days. What to do?

Please assist.

The tax transcripts are considered a complete tax return as it is what the IRS accepted and processed. You cannot fake them. They are better than trying to get a COMPLETE tax return with all the W-2s, schedules and worksheets. It sounds like you have a complicated tax return like I did. They accepted my tax transcripts without any problems and I had to file schedule A, B, C, D and E as I had a couple of businesses that reported income on a K-1.

Order the tax transcripts from the IRS. You can have them faxed if you are in a real hurry, but why the rush? Better to send in the tax transcripts then to delay your AOS with an RFE.

Thank you for posting this. I know the transcripts included the schedule C info, because they do on mine, but I had read years ago that if you have a complicated tax return then it is best to use a complete copy of the return instead of a transcript. I am glad to know the transcript works for even the most complicated returns that include many types of schedules.
