Hi,

USCIS received our responses for the request for evidence on 4th of September, but we have yet to receive our NOA2. I called USCIS before I left out of the country on November 1st, and the one representative told me that 60 days was only the average time. However, I called yesterday as we still haven't received the NOA2, and the USCIS representative filed a formal status request. First, has anyone else experienced this delay in receiving the NOA2?

Second, after we receive the NOA2, can you please remind us what happens? Do we receive a letter scheduling my fiance's interview? And then do we schedule it and then wam, we are done and he can finally buy his ticket to come to the US? Or how does this work? We are toying with the idea of obtaining an immigration lawyer, even though it would be a financial struggle, as we feel we are getting stuck.

We believe that he needs the police clearance records which is going to be another major hurdle, but please let us know. We were hoping he would be here by Christmas as our filing date was March 4th, but given that it is November 24th and we have yet to receive our NOA2, this seems bleak. But please let us know your thoughts. Any guidance, motivation, or anything would be very much appreciated:).

Why is the police clearance a major hurdle? It's a pretty simple process in Ukraine. I think Christmas is really out of the question at this point. Also remember that everything closes down in Ukraine for the first two weeks in January. So you are most likely looking at the end of January or even February to get the visa in hand if all goes well.

Also, you can get a complete overview and instructions as to what to do next at the US Embassy of Ukraine web site and the K1 guides here. I think there is no need to hire an immigration lawyer at this point since you've already done 90% of the work. If you get a denial, then you might consider hiring one.
