I need help please. I just joined visajourney...my fiance has been approved and expects to get his visa next week. However, i am confused as to the guidlines. His visa will expire in June. I realize he must travel here before then. What is unclear to me is if we must be married before his visa expires in June or if we still have three months to get married. If he is here and his visa is expired but we still marry within the three months of entry are we okay? or would he be here illegally if we weren't married before the visa expired. I hope my question is clear. thanks for any help!!!

He has 6 months from the date the visa is issued in which to enter the US. Once he's in the US, the visa's 6 month validity is no longer relevant - you have 90 days from the day he enters the country to get married. :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Yes K-1 you need to "Activate" the visa within 6 months, once in country you then have 90 days to marry no matter if a few weeks or 6 months after the visa has been issued.

The expiration date of the visa in not the date that you need to marry by it is the expiration date of the I-94 form that is issued when you enter the country which is the date that you will need to marry by.
