Hi everyone!

I just saw the free lawyer at my school and we were both stump on how to answer this question on the form. It's the question asking if this is your third or more time applying for a visa like this and if so to check one of the boxes and attach the right form with it.

I originally checked "non-applicable, beneficiary is my spouse" but the lawyer told me to leave it blank since my beneficiary is not my spouse and the question doesn't apply to me. Does anyone know what to do? I think for now I will leave it blank but I just wanted to double check with you guys smile.png. Thanks for your help!!

We left blank since those questions are not applicable for my fiance and I. My question for you, is this first time you filed I-129F? That box is only applicable if you filed for third times or your first approval of I-129F is within 2 years from now. You can't checked " non-applicable, beneficiary is my spouse, I believe this question only for petitioning for K-3 visa (a petitioner has to file I-130 and I-129F even though K-3 visa is now obsolete)

That box is only applicable if you filed for third times or your first approval of I-129F is within 2 years from now. You can't checked " non-applicable, beneficiary is my spouse, I believe this question only for petitioning for K-3 visa.

Yeah it's my first time and I am applying for the K-1 visa. Ok that makes sense!! Thanks for helping me out, hopefully will have this massive packet done soon :) !!

Yes, it is a correct form. I'm opening now a copy of I-129F that my fiance sent to me. The form expires 6/30/2016. Surely the OP and I are looking at same form.

There is a new form now since September 2013, I think? But yeah it's the right form!
