First of all, I would like to say thank you to all VJ members for you Help, Time, support, sharing your knowledge and experience, you guys here are an exemple of how to cooperate and get things done.

I'm filling I-751 by myself since i'm divorced, and really would like your thoughts and opinions so here's my story in a few words.

1. Summer 2010, I met my "ex wife".

2. November 2011 we got married.

3. May 2012 received my GC.

4. After multiple nasty arguments we had, wife decided that we should separate, and ultimately moved out in July 2012.

5. September 2013 we finalized our divorce.

and here is the evidences that i have:

*Bank statements from marriage until july 2013.

*A Lease with both our names on it.

*Affidavits From: ex wife, a friend of mine that had met Karah, myself, sponsor, my friend/former boss, current Girlfriend,

*two electrical bills with both our names.

*tax returns, we filed separate but we put "married".

*my employment file, because there is a section where i had to mention my martial status.

*copy of divorce decree.

ex wife destroyed many memories and evidences because she was upset and knew i would need those in the future, "photos, bills". but we recently became "friendly" and things got better.

I really would like to know your opinions and if there is anything that i should add or change when filling the I-751.

Since you have divorce decree, you need to file immediately with whatever evidence you have. Try to get as much evidence as possible (you have some good evidence) but you will still be called for an interview. Since your ex-wife is co-operating, try to see that you have evidence that covers the period you are married.

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

That's all i could get as evidences. and for the interview, i know everyone cases is different but i knew some people that were in my situation and got approved with no RFE nor interview, how likely is that ? is it because they sent enough evidences?, any thoughts on that?

I have been approved yesterday after RFE of financial co-mingling. I did not have all the evidence but as long as you explain everything - you are good. If you get a RFE, it is no big deal - they are just trying to approve you without an interview :)

My husband and I are on the process of our divorce as well and we have our final trial on December 18th. My greencard expires next year, I was just wondering if I could renew my green card after the divorce? Please advise. Thanks.

Yes, as soon as you get the decree in hand you can file or if you didn't get it in hand by 90 days before your GC expiry, then it is at that time.

Am I going to have a problem removing the conditions of my greencard since I am no longer married to my husband?

No, as long as you entered the marriage genuinely intending to stay married. Of course you will need all the evidence possible for the period you are married to show the joint living and joint finances.

My husband signed the Affidavit of Support (I-864 Form) and he is currently doing the obligation that says on the I-864 Form. However, how long is he financially responsible to us? According to my husband he is only financially responsible until December 14, 2014 since that's when my conditional greencard expires. Is this true or is he still going to provide for us financially eventhough I already removed the conditions on my greencard?

His obligation will not expiry till you either become I) a citizen or ii) you work for work for 40 quarters or iii) cease to be a permanent resident or iv) have a new affidavit of support due to new process on account of removal proceedings or v) dies. And divorce has no role in this and the obligation continues.

These are all the different cases under which the obligation of the sponsor ends. In your case the 40 quarters will not kick in anytime in near future, as it takes at least 10 years to complete 40 quarters of work (there are 4 quarters in a year). So don't worry about that.

Sometimes a permanent resident is ordered to be deported for whatever the reason may be and then he or she may find a new sponsor for support. In such cases also the old sponsorship of support gets terminated. This doesn't apply to you.

The bottom-line is that your husband will have the obligation even after the divorce till you become a US Citizen (you can become US citizen after 3 years of your GC issue date and can apply 90 days in advance).
