Don't look at my timeline.

I am asking help

for my father.

My father is a permanent resident since march 10, 2013. He is petitioning for his minor son. (F2a category)

Current status: We sent out all Affidavit of support documents and IV documents already and waiting for case completion.

But we received an email: AOS checklist asking for my father's 2012 income tax return.

Question: How can they asked for this when we included in the AOS a letter explaining why my father has no tax return yet. He is not even in the USA on this year (2012), He just arrived here on March 10,2013! And was just recently hired on Aug 28,2013. What should we do now?

Question 2: In the part of AOS form, where it is asking for my father's annual income, what amount should we put? No tax return yet. Where can we get the number to put there because what we did is just estimate. His monthly income x 12 months. Or did we make a mistake estimating the annual income? Is it better if we put 0 instead since he just started working and no tax return to back up the amount that we put there.

Please help. If you have a similar situation pls help us.

I also have no 2012 Tax since i didnt have any job and i also gave them an explanation letter with attached irs publication 17. BUT in my AOS form i made some notations using a pencil. explained again that I dont have any itr.

Income, just to justify your computation, an attached employment letter was again attached.

in itr columns wherein they are asking for the details of your last 3 recent years, again i made some notations.

Sometimes it helps to make some notations so that they are aware of your income status and reasons why you are not ticking or filling up an item. There are some items that it really requires that you have to answer thats why it is so confusing sometimes .

And i think it also helps that you have document tabs to indicate what kind of document it is so its easier for them to pull out the document for reference.

I know the NVC website doesn't say anything about including letter of employment and pay stubs, but I think you should include this as this is the proof that your father is in fact working.

Did your father include any evidence of employment or pay stubs when he submitted the AOS?

Oh wow! I think you did good with the notations. You are right there are items that require more explanation. We will do that now. We included a cover letter with all the documents submitted for reference. As for the annual income where you have to attach the employment letter, we also do that but the problem is in my father's employment letter, the HR just include his name, the company and the date he started and refused to include his monthly income or hourly rate since he just started working there. So i just based the computation or estimate of his annual income from one his paystubs. So, estimating the annual income is okay right as long as you will make a notation how you come up with the number?

Yes, we did include the letter of employment and all the pay stubs he got.

Is it crucial to include publication 17 when writing a letter of explanation for not filing tax returns? I'm just curious.

It can be, so you can show the AOS reviewer that you have a basis or reference on why you are not required by the IRS to file an income tax return because of such reason that is stated on the publication .

A cover letter with few pay stubs with realistic estimated income for 2013 is good. They just want to make sure that beneficiary will not be a public charge and if you can prove that then you will be OK.
