Hi all!

Just have a couple questions regarding the VWP. I am an Australian citizen and therefore eligble for the VWP which I have used in previous visits to the US.

I am planning on going for a holiday which will see me land in LAX (for one day only) then go to South America for a few months and then plan on coming back to the US for up to 90 days (no set departure date).

My question is :

1) Do i need to have 2 VWP's - one for my initial arrival in LAX and one for my holiday in the states after Sth America?

2) If after say 80 days in the US i left to go back to south america for a fortnight, what are my chances of coming back to the US on the VWP?

You'd be given 2 I94s (which are now virtual, so no hard copy).

After your fortnight absence, you'd probably be allowed back in depending on the circumstances (how long you intend to stay on your second entry, if you have a flight back home, the mood of the immigration officer, etc.).

How detrimental would it be if i didnt have a return flight - seeing as i am not sure where i will be departing from? That is, how "set in stone" does my itinerary have to be?

Also - i wasnt quite clear on the 2 I94's? Can someone explain this to me..

The first trip should be ok ( there is some rule about the clock not resetting by going to Canada or Mexico or ?? ( not sure if you are going to one of those places )

It is the second trip to the south and return where you will probably have issues

This will not be over quickly. You will not enjoy this.

You will not even be allowed to board the plane without a return ticket out of the US. I know, because I didn't think to bring my itinerary with me on a trip to Jamaica and nearly wasn't allowed to board the plane to Atlanta, Georgia. When I was going through passport control, I was directed to some large room where a few other aliens were being questioned. I told the officer there I had already shown my itinerary in LAX, and they wouldn't have let me in without it (I was also on VWP). He just replied, "But you're going through Atlanta now, and you have to show ME that you have a return ticket." In the end, I had to give him my email address and password while he went off down some corridor to login to a computer. He still could not find my itinerary and had to call me in to find it for him. I was there for close to an hour before he stamped my passport and said, "Next time, remember to bring your itinerary."

My advice: Don't risk it.

When you enter for 1 day, you'll be allowed to enter with an I94. When you lave North America, that expires or is revoked or whatever. So, when you come back, you'll get a new one.

It'd be better if you have a flight out, if only a refundable full-fare ticket for when you go through immigration. Otherwise, you'd have to try and prove that you have a tonne of funds instead. Do you have a job waiting for you back home? People with unlimited free time are not well liked by US border agents.
