K-1 Visa possible with 5 Year ban?

I was deemed inadmissible to the US in late May 2013 because I was overusing my B2 Holiday Visa, the officer said I was not being deported but rather "my request to withdraw my application for admission was approved" and I then booked a flight home to Ireland and was escorted to the plane.

A few weeks later I applied for the B2 again dumb I know but the officer in Atlanta mentioned I could. In Dublin they said I was banned for 5 years.

I had a US fiancee she lives in the USA so we have petitioned for a K-1 Visa on Sept 15th 2013. She has received the first NOA at this stage.

My question is does anyone know if I will have to serve a 5 year ban? The code on my passport is: 22CFR 41.122 (H) 3

I could see it certainly being a problem.

All NoA 1 is is the acknowledgement that they've received the form. I'd wager a guess that it won't go any further and will be denied when they look at it for the purposes of approving the go ahead for K-1/NoA 2.
