Hello all!

I moved the United Stated on August 11th 2011 on a CR-1 VISA.

I've submitted my I-751 on June 5th. Had my biometrics scheduled in July 2nd. All good. In September 29th, I have received an RFE requesting the following:

Legible copies of ID

Evidence of Good Faith Marriage:

  • The vehicle insurance documents, lease agreement, and bank statements submitted are dated recently and do not cover the period of marriage.
  • The 2011 and 2012 tax returns submitted are incomplete. W-2 statements were not attached.

I got the vehicle insurance info (with both names on it) since October 2011 (when we bought our car) to this month. From august 2011 to October 2011 my husband and I lived with his grandfather (I wrote a letter explain that), I got the copies of our lease agreements from our first place from October 2011 till april 2012 and I am submitting the 2012 till 2013, as well.

The bank statements-- we have two accounts. One was my husband's account and he added me to it only in August 2012. I got all the statements since august till today. And I put a note explaining that my husband added me to the account only in 2012, that's why my name only shows up after this date. The other account we have, we opened together in October 2011. I got all the statements of this account since oct 2011.

The tax return is incomplete. Does that mean it is incomplete or they mean the W-2 is missing. I have no idea where my tax return documents are now and I checked at the IRS website and it takes 60 days to request a transcript. I have ALL the W-2 since 2011 though. Would this be enough?

I have also included some pages of posts from me and my husband on facebook since 2011. Do you think this is a proof, too?

I am getting ready to submit this all but I am to make sure I am not missing anything.

It doesnt take 60 days to get a tax transcript...it only took 5 days a couple weeks ago. Of course they may have slowed down because of the government shutdown, but it wont take 60 days. Best of luck to you, the RFE process sure is frustrating, but you will get through it.

7/2/10- NOA1

2/9/11- NOA2 (transferred to Texas)

NVC

2/28/11- case number received

3/2/11- Paid AOS bill

3/5/11- Paid IV bill

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

A tax return is different from a tax transcript in that it only shows you have completed a return but doesn't mean IRS received it and processed it (something like that). A tax transcript is proof directly from the IRS showing that your tax return has been received and processed and acknowledged. The reason why your tax return is considered incomplete without your W-2s is because your W-2s are evidences of how much you have been paid, how much you owe etc. Without W-2s the tax return is meaningless.

My experience with getting the tax transcript was pretty quick. Maybe they are currently affected by the government shutdown and it may potentially cause a backlog. But it wouldn't hurt to order it, whether or not you can submit it in time before your deadline to respond RFE hits.

In the meantime, did you keep copies of your original ROC application? If so, then get a copy of the tax return that you submitted and resubmit with all of your W-2s. Otherwise, if you filed tax returns with TurboTax, you can download them online. If not, then you'll have to dig them up :\

I am continuously amazed at the amount of specific details some of you are getting on your RFE and wish my case reviewer will be more detailed-oriented (I think mine is a bit lazy LOL).

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.
