Hi to all members of Visajourny,

My NOA 2 date September, 17, 2013 and PD, April 29 2013 im little confused will i get visa in this situation some people say regression will happen and why the NVC receiving case very late and when ill get my case number shoud i wait for 30 days i am miner children.

Thanks ill be glad for a good answers

You have not provided enough information.

All you have provided is the PD and when you got the NOA2.

How old are the children?

If the children are 2 years old, then retrogression is not a problem.

If the children are 20 years old, then retrogression could be a problem.

No way to answer your question without knowing the exact ages of the children.

As aaron mentioned, it is highly dependent on the children's age. Your PD is April 2013. That is pretty new. You have some time to go. There are people who are waiting since 2010 and 2011 and yet they don't have an interview scheduled. If the children are close to turning 21 years old, let NVC know about it. Otherwise a retrogression won't harm you. Good luck.

Yeah 12 years old and 20, 8 month left turning 21 and what u mean its new, so if nvc recive my files will they process not mine and old filers ?

The 12 years old is fine. Retrogression will not matter.

The 20 years 8 months old may have a problem. In all likelihood, this child is fine with retrogression. The child has about 5 months of CSPA protection because it took 5 months to approve the I-130. As long as the PD is current before the child turns 21 years and 5 months, then there is no problem with retrogression. The child will only age out if the child turns 21 years and 5 months and the PD is not current. The sooner you file the DS-260, the better off you are since the PD is current right now and you can lock the child CSPA age in.

Believe me, I assure you retrogression won't happen in the next 3-5 months. If you understand the US immigration process in depth you will know why. But after that it will happen in my opinion. So you have to try to be very proactive with NVC in cases when it is possible

You might need to contact NVC and let them know that your petition is approved and beneficiary is aging out and seeking to acquire permanent residence status while the PD is still current. Hopefully they would be able to assign case number fast enough for you to be able to take advantage of current PD. Good luck!

Texas Star, can you please elaborate on your statement about retrogression not happening in the next 3-5 months. Please share your thoughts/guesses on that subject. I think most people would agree that the main reason they didn't leave PD current for October (the cut off being Sep08) was to show that retrogression will happen in the following months unfortunately. I think you are missing the big picture... but never-mind there is no logic retrogression to happen in October to December. This is the first quarter of 2014 fiscal year...

Reason for Sept 2013 date is the following - "We think we have enough visa applications in the queue to fill 77%(and maybe little bit more) of the overall second preference for 2014 fiscal, and we are making a baseline until here".

I don't know the exact numbers of visa applications in different stage right but just saying.

Even in the official site is stated when retrogression happens - and believe me it is not stated that happens in the beginning of the fiscal year ;-)

What you (and most people as you stated) guess - level staged retrogression - I think this is at least not the "friendly fellow human" way of dealing with people :-)

I hope you r correct with your "predictions":) really do! I have been only following VB and PD for the last couple months, so can't say I am a "pro" in this subject. But since when logic is the best attribute of the whole immigration system? It would be really amazing to actually see that they are indeed being logical here with all their calculations, just a thought.

Oh and thank you for clarifying your logic behind this matter ;)

There is nothing the OP can do to change anything.

"Assuring" that the PD will not retrogress is irresponsible. No one can know what will happen in future visa bulletins. No one predicted the last retrogression. It's only wishful thinking to think you will know what will happen in the future and to "assure" anyone anything about future visa bulletins.

Asking NVC to expedite it's processing is useless. The case is already being processed since the PD is current. It can't go faster because it is already being worked on.
