Great site!!!

I married and divorced a USC. I have two children from this marriage. One is 18yo and the other one is 15yo. Both of my children were born in Costa Rica. At the time my husband was not a USC, but a resident. We came to the US about twelve years ago on a tourist visa and then my ex-husband became a USC and petitioned us and we became residents.

My question is: I am applying for USC. Can I include my children on my application or do I need a separate one? Which one? What are the prices for each one? What documents do I need for my children?

Thank you for your help.

Is the ex-husband, the children's biological or adoptive father? If yes, then they are already US citizens.

The Child Citizenship Act automatically (no paperwork required) confers US citizenship when a child meets all four requirements; 1) a US citizen parent, 2) the child lives with the US citizen parent, 3) the child is under age 18, and 4) the child has a green card.

You can apply for US passports for them if on any day, they met the 4 requirements of the CCA. The US passports will prove that they are US citizens.

If you can't prove they gained US citizenship under the CCA from their father, then only the 15 years old will be a US citizen when you naturalize. The 18 years old will need to apply on his own.

Yes. The father is the biological father. I came with our two children to the US on a tourist visa and then the father (my ex-husband), who was a resident (now he is a USC), filed to immigration to legalize our status. That is how we (mom and two children) obtained our green card.

Thank you aaron.
