I'm a Vietnamese. I met my fiance in Jan, 2013 and he came back the U.S in May, 2013. We're intend to do the K1 but it's seem hard for us with his financial.

His 2009 Income - 38,877,

2010 Income - 33, 612,

2011 Income - 13,800,

2012 Income - 18, 512

and from May, 2013 - Sept, 2013 his income is 12,000, plus 7,000 from school grant and loan. He's 35 years old, a self-employed and still a student so he doesnt have pay-stubs, no monthly income, he just only has annual income.

Please anybody knows some information:

1-Does school grant can be counted as an income ?

2- We're going to apply K1 in the end of this year so his income must above the poverty guideline 2013 or 2014 ?

3-Do we need to show income from 2009 to 2013 or just 2013 ?

I think they only care the last income tax return and you have said that you will apply at the end of this year. That means they will ask for Income Tax 2013. I dont know whether they account grant or loan.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

My boyfriend and I have the same problem. We are planning to file for K-1 visa but dis income does not meet the poverty guidelines. Can assets (like a house) be added to his income to pass this? Also, do poverty guidelines differ each year?

For self employed, line 22 of the most recent tax return counts. So considering you will file in late 2013, buy the time you need the I-134 it will likely be the 2013 tax return, files by April 2014. What kind of school grant is it? It may count, but it's not ongoing so probably not.

Yes, assets can count, but you need x5 the income short fall. A family home won;t count, as it would be undue hardship to sell it, but if there is a second property or car, a 401K or similar, that can count.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
