I have a question. My Husband will file for me the I-130 and I-485 this week. Now that Oct bulletin was release can he still file both the I-130 and I-485 at the same time? I am legally staying here in US (B2-tourist). Can I still legally stay here even we file after the Sept 8, 2013?

09/20/2013 Delivered to USCIS Chicago lockbox
09/28/2013 Four I-797C notice of action in mail
09/28/2013 I-130/I-765/I-131 online status: Initial Review; I-484 online status: Acceptance
09/30/2013 Biometrics appointment in mail. Appointment scheduled on 10/17/2013
10/10/2013 I-485 case status updated to RFE
10/17/2013 Biometrics done
10/23/2013 RFE response mailed out
10/28/2013 I-485 online status: RFE response review
11/14/2013 I-765 online status: Card production ordered; I-131: Approved
11/19/2013 I-765 online status: Card production ordered again
11/21/2013 I-765 online status: Card mailed
11/23/2013 EAD/AP card in mail
11/27/2013 I-485 online status: Testing and Interview
12/05/2013 I-485 online status showing the interview date (01/08/2014)

01/08/2014 Interview done

01/31/2014 I-485 online status: Initial Review

01/31/2014 I-130 online status: Approved

You can only stay in the US within the duration of your B2 visa. Do not overstay.

Your husband can file i-130 but you have to go back to your home country.
