Hi,

I'm American in France and getting ready to begin the visa process for my husband who's European. With the I-130 petition they ask for evidence of our bona fide marriage. Along with my marriage certificate, they ask for one other source of proof. Is sending the consular birth certificates of my children as further evidence enough? Or should I include our apartment rental agreement too? If I include the rental agreement, do I need to have all the pages translated or just the primary two with our names and signatures. Thanks to all who can advise on this!!!

Your marriage cert and the birthcerts of the kids, along with maybe a few photos, are plenty for the petition (ie when you first send in I-130). When it comes time for interview, many months down the line, he can bring more proof such as joint bils and lease, more photos etc.

Honestly- he is from France, you have lived together for a while, I don't forsee many problems :)

For photos, the easiest is to color print 4 or 6 to a letter/ A4 sized page with a little caption underneath of the date and what it shows (wedding, first holiday together, anniversary etc...). A couple of those pages should be plenty.

Thank you Queen P. :-) May I ask you one other question please? Once we begin this process, would he be able to go to the U.S. to visit? I am considering moving on over there in order to set up, and am wondering if he could come there for holidays (for example) or not?

Yes it is possible for your husband to travel US at the time of processing I-130 in tourist visa.

Since he is from France, he shouldn't even need a tourist visa, he can visit on the VWP.

Yes you can use the primary two pages of your rental agreement showing both names and signatures as further bona fide marriage evidence.

With the lease agreement and any other evidence, if you're mailing the I-130 petition into a lockbox then you must do a translation of the documents.

If DCF, the documents do not need to be translated. I do not think there's DCF in France so this point may be moot anyway.

Your husband can also visit you in the US using VWP while the petition is processing/pending. Good luck!
