  1. This is the continuation thread for Part II, which has been closed because of its size.
  2. Hi everyone! My boyfriend (US citizen) and I (French citizen) met in July 2018 (almost 18 months ago) while on a trip with friends. Since then, I’ve gone to see him 3 times for about a month each time, and he’s come over just once. We want to get married and live together in the US. We have a ton of questions, and it’s hard to know where to start. Here are a few of those questions: - Where should we get married? In France or in the US? The goal is for me to move to the US, so depending on where we get married, the process won’t be the same. - I work as a freelancer (which is why I can go see him for extended periods of time so often). I work for French clients, and when I spend time in the US, I’m not there to work (i.e. to "steal" an American citizen’s job), I’m doing the same work as if I were in France or anywhere else. Could this be an issue? - If we decide to get married in the US and apply for a K1 Visa for me, can I still visit him under the ESTA waiver program? Mine is only valid until June 2020. If needed, can I apply for a new ESTA visa while the K1 process is still underway? - He’s coming to visit me and meet my family in May, should we just get married in France then? Could I easily move to the US after that, and not just under the ESTA waiver program? Sorry if this is a bit all over the place… Thank you so much for your help and input!
  3. Hi everyone! My Fiancee and me are planning to apply for the K1 visa so we can get married in the US and then apply for AOS and immigrate to the US. She is from Virginia and is been living in Paris for the past 5 years. I'm french and we've been living together for two years now. I've seen that the sponsor (Her) has to meet the Federal minimum income requirement which is almost $17,000 per year. I've also seen that this income has to be US-based. Can we still apply for the K1 visa since we BOTH live and work outside the US? Thanks a lot!
  4. My boyfriend came here on a student visa when he was 17, his visa was to expire before his 18th birthday. So his sister's husband adopted him around that time,(his mom had no way of taking care of him) his sister told him his renewal for the visa was denied, come to found out she never reapplied for him. Fast forward its been 10 years since that happened. We tried filing before but its hard to know what we can or can't do. We want to get married. I just need advise badly. Thanks for all your time.
  5. Hi everybody, First of all, I would like to say I am really happy to have found this Forum I would like to have your advice about the best way to go to the USA to live in there. I am French and I live with a French-American Woman in Paris, France. We both work in Paris and plan to go and live in the United States, Florida to be more precise. We are not married for the moment but we will be in 3 months (November 2018). More information about our situation: - My wife-to-be doesn't have a residence, as she lives in Paris, France - My wife lived in the USA from 1 year old to approx. 10 years old but never worked there - Even if she never worked there and never had to pay taxes, she submitted her tax returns - My wife's current employer is an American company. She will have a position in the US before leaving France - She has family in the US: - American cousins who live and work in the US - her brother, who he's American and French and has been working in Florida since 1 year - her mother, who he's French & married to an American since +10 years and has a Green Card. She has incomes (buying & reselling real estate after renovating it + French pension) In your opinion, what's our best option for me to live and work in the USA in order to follow my wife-to-be? I am considering 3 VISA but I'm not sure: - K1 => If I well understood, this VISA is only suitable for a foreign fiancé. As we plan to be married in 3 months, I think we can't apply for this VISA. Do you agree? Do you think we can try it before getting married? - K3 => As I understood, this VISA is kind of obsolete or, at least, I should chose the IR1/CR1 instead. - IR1 or CR1 => I think it's the most suitable VISA for my situation but my wife-to-be must have a residence in the US and submit the Affidavit of Support.   6. Hi everyone! We are looking for information about the DCF at the french embassy. My wife is american and we live together in france since our wedding almost two years ago. She wants to go back to the states because she is needed in her family business. We read a lot of information, and just before sending the I-130 to the lockbox in chicago, we discovered there was a shorter way for the US citizen living abroad : the Direct Consular Filing. We saw some cases that took only few months to get their visa. So, we did what they did : sending an email explaining the situation to the embassy. But they responded saying they are not doing it anymore since 2011. here is their answer : Dear M. Minix, Effective August 15, 2011, all I-130 petitions for an immediate relative must be filed directly with the United States Citizenship and Immigration Services (USCIS) Chicago lockbox and the information you need most will be found at www.uscis.gov. Only once you have successfully filed your petition with USCIS and completed the necessary processing will your file be transferred to the National Visa Center (NVC). This procedure from USCIS to NVC to Paris will take few months. You may follow up your case on line via the following website https://egov.uscis.gov/cris/Dashboard.do by entering your case number provided by NVC. You can also find additional information on the process at www.travel.state.gov. Posts receive hardcopy files within three weeks prior the interview of eligibility scheduled by NVC. Educating yourself on the process by visiting the links above and preparing all the necessary information/documents is the best way to expedite the procedure. Thank you for your inquiry.
