I lodged my I-130 for my spouse who is in india in feb 2013, and received the electronic notification that they'd received it.Today, I went online to the USCIS website to check its status. It said that my application is in 'Post Decision Activity' and said:



"On August 22, 2013, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.


For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."


What does this mean?Does it mean that the application has been approved an sent to the NVC?Does anyone know from here how long the process may take, how long will it take for them to set an interview with my husband in india ,couple of months or upto a year?



Also while we were waiting for i130 to be approved, i had filed for a visiting visa for my husband so that he could be here with me for my birthday.If his visiting visa gets approved and while he is in the states will the spouse visa process continue as usual or will the visiting visa interrupt it?

Would you mind sharing your service center, probably it is California but nevertheless. Would be great to see some Vermont 2013 filers to get approved.

July 11, 2013 - NOA 1

September 12, 2013 - Transfer to Nebraska

September 20, 2013 - Case touched

November 14, 2013 - NOA 2

Case shipped to DOS - November 19, 2013

NVC Stage

December 11, 2013 - NVC received my case

December 30, 2013 - NVC case number issued

January 2, 2013 - NVC issued invoice number

January 13, 2013 - DS261 filled out

January 15, 2013 - AOS invoice received and paid

January 17, 2013 - AOS package sent

January 21, 2014 - Fed ex delivered package (NVC confirmed receipt on 22nd)

January 21, 2014 - IV fee invoice received and paid

January 22, 2014 - IV documents sent (payment in process but cleared from bank)

January 23, 2014 - submitted DS260 form, iv documents delivered per fedex (24th per NVC)

February 12, 2014 - received fake checklist for IV package

February 21, 2014 - Case completed (by phone)

April 2, 2014 - Called and got interview date May 13, 2014

May 13, 2014 - Counsel needed some time to to review docs

May 27, 2014 - Interview round two and visa approved

June 2, 2014 - Visa pick up date

Frst of all congrats for the approval bec it takes so much time to wait n tu already passed it bec i am also a feb filler n still waiting for the approval :(

Ne u r case will be fwd to nvc within 8-9 weeks just call thm n ask for u r mtl number once u get it aftr tht thy will send u the forms n to u r beneficiary also

It takes approxi 3-4 mnths till the visa on hand

It means the I-130 was approved and the next step is the NVC. You will be sent a fee letter to start the visa application process. It should take about another 6 months for a visa (NVC document collection, interview, then visa).

If he gets a visitor visa, he can visit the US. However, he must return to India to get his immigration visa. Do not try to adjust his status because it is obvious that he has immigrant intent at this point.

Not sure if this will help or not but my fiance and I are going through a similar process. The petition was approved 7/24/13 and I received a letter from the NVC, dated 8/5/13, that they received the approved petition and were sending it on the Indian embassy. We haven't heard anything else and my fiance is still awaiting his instruction packet in the mail.

He also tried for a tourist visa but it was not approved cray5ol.gif

well, i hope its couple of months, i was under an impression it could take upto 2 yrs....i have my fingers crossed.

Do you know if it is okay to go ahead with the visiting visa application or do we wait since are process for i130 has started.And if he gets rejected for visiting visa will tht impact his interview for spouse visa?

well, i hope its couple of months, i was under an impression it could take upto 2 yrs....i have my fingers crossed.

The PD for the F2a was about 2-3 years behind when you filed. Now, it's current. That's the reason for the change in time to get a visa.

On August 1, 2013, the Priority Date for all F2a beneficiaries became current unexpectedly. The State Dept. expects it to retrogress in October. This is why it's taking a couple of months right now and not 2 years. If the PD retrogresses a lot (which is not expected) and your husband's PD is no longer current, then it will need to be current again before your husband can get an immigration visa.

He can apply for the visitor visa. A denial for a visitor visa will not affect the spousal visa.
