Question about filing I-485

Timeline

Hello,

I'm currently under F1status with OPT (Employment authorization), and applying for AOS.

My spouse and I are filing I-130, I-485, I-693, and I-864.

Since I'm under OPT card, I don't have to apply for I-765. In this case, should I go head make a copy of OPT card and attach to I-485? OR should I attach I-797C, Notice of Action from I-765 for evidence?

If you are familiar with this situation, your advice/help would be appreciated.

You should apply for an EAD anyway. 1) It's free. 2) It allows you to work in any field, not just your major like OPT, and you don't lose it if you have too many days of unemployment. and 3) Even if you get it, you don't have to use it. So it cannot hurt.

If not, why would you need to attach your current EAD? I see no place that wants that, except when applying for a new EAD.

Actually, I never thought about applying 765 again, but I think that's a good point.

I was gonna make copy of OPT card, because that shows that I've already applied for before, and let them know I'm under F1 OPT.

Do you think sending/filing another I-765 wouldn't make them confused though?

They are smarter than that. It won't get them confused. And they already know you are under F1. The EAD based on a I-485 is free, so there is no downside.

I guess so. and I agree with you as well. I think I should consider reapplying it after more research.
