Hi everyone!

I immigrated at k-1 visa. We got married, couple weeks ago I received my green card. Now I want to apply for my son. He is 19 and unmarried. I wrote to American Consulate in Armenia where he is, and they said, they closed my case. I am in USA less than 1 year so my son still eligible to apply for his K-2 visa. I started filing i-824, and I have a question. What do they mean of original petition? Do they mean I-129F based on which I received my K-1 visa or last one I-845 Adjustment of status that has been approved recently? Thank you for any response

Was the 19 year old mentioned in the original petition?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Was the 19 year old mentioned in the original petition?

Did you list him a To Join on the 156k form?

If not them he can only come over on. 130 petition that would be best filed by your USC spouse.

If you didn't list him then they wouldn't have closed your case. You do have to follow the instructions and can not ad lib as you go.

Yes, he was mentioned as my son everywhere it was asked. That time he just turned 18. However, I did not check the box of follow-to-join that time. It seemed to me it was better for him to stay at home as far as I would set up here and find a job. I said interviewer that I would bring my son but did not mentioned follow-to-join. If I send i-824, how long does it take to bring him to US?

My ex-husband (my son's biological father) also applied for him last year (I-130). Petition was approved on June 19, 2013 and sent to NVC. The same day his father became citizen. Unfortunately, petition hasn't been received by NVC yet. What's the reason of such delay I don't know. We have called many times, they say, just wait or send inquiry request. I have done it, but I am afraid, my son's petition has been lost. that's why I get nervous. Moreover, his father can't upgrade petition as he became citizen because NVC says they have no petition yet. So, I decided to apply for my son on my own, based on my k-1 visa to be sure that, if they lost his case, they could start new one. I try not to waste time moving both directions.
