can i file i-824 for my sibling

Hi,

I just recently file i-130 for my parents and they were approved by USCIS. Next month, they are having an interview with the Consolate. However, due to the new regulation, my brother and sisters can't come along with my Parents. I was reading something regarding the I-824. Can i use this form to bring my brother and sisters as Following-To-Join? I read the form and kinda confused. I didn't file an I-130 for my brother and sisters. I though it is better to wait for my parents to file the form since it takes atleast 10 years for my application to be accept and it only takes 3 years for my parents. Does that mean, now i have to wait for my parents come to the US for 3 years in order for my brother and sisters to come here? Is there anyway that i can expedite the process? I really want to be reunited with my family in the U.S. Any help is greatly appreciated.

When a USC files for a parent, it's an Immediate Relative case and only the parent can get a visa. So, you cannot do a Follow-to-Join because derivative beneficiaries are not allowed in Immediate Relative cases.

As soon as your parents become LPRs, they can file for unmarried children. If the child is under 21, then its about one year for a visa. If the the child is over 21, then it's 7 years for a visa. LPRs cannot file for married children, so marriages disqualifies the child. The child must stay unmarried until the child gets a green card.

There is no way to expedite this. We are all waiting for our families. If there was a way to expedite, then we all would have taken advantage of it. Your family will have to wait just like the rest of our parents and siblings. No family gets to go ahead of another.
