We'd like to apply for my wife's parents to come over under IR-5.

I'm curious about any limitations on their resident card.

  1. Is it conditional like my wife's was after getting it through our marriage?
  2. Are they mandated to stay here for a specific amount of time before getting the physical card?
  3. Are they required to stay in the USA for a specific amount of days annually? I assume this is like other residents...
  4. Do they have to come to the USA immediately upon grant of the green card stamp? Or, can they come later?
  5. Does a later entry date alter the delivery of the physical green card?

I don't want to apply until we know how this will affect their lives since there are elderly grandparents and siblings to remain in the home country.

A green card is to live in the US , to keep a green card they are to live in the US more than they are out. They will also have to file taxes and maintain a residence here. I assume your wife is a citizen now, They can leave with thee stamp but once again they must meet the physical time in the US every year to keep their status. It kind of sounds like you need a visitors visa not a green card.

This will not be over quickly. You will not enjoy this.

Their intent is to stay here a majority of the year, but my main concern is their ability to depart for family ailments or whatever. The remaining grandparents of my wife are in bad health and are quite elderly. So I can imagine a number of returns to handle those matters...

I'm only trying to think up scenarios and figure it all out so I can give them all the info possible for their decision. Hence my number of questions above to understand the process.
